RESOLUTION No. 105 99
RESOLUTION AUTHORIZING THE ISSUANCE OF A LICENSE OVER A PORTION
OF THE FORMER HAMAKUA SUGAR COMPANY, INC. LANDS NOW UNDER
COUNTY OWNERSHIP SITUATE AT WAIKOEKOE, HAMAKUA, HAWAII, TAX
MAP KEY: 3RD/4-8-03:05 (PORTION)
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
WHEREAS, in 1994, the Council of the County of Hawaii agreed to accept
approximately 4,400 acres of land by Commissioner's Quitclaim Deed as a
settlement for retroactive real property taxes among Western Farm Credit Bank, the
County of Hawaii and Hamakua Sugar Company, Inc.; and
WHEREAS, pursuant to Resolution No. 333-98 (Draft 2), as amended, the
Council of the County of Hawaii requested that the Mayor reformulate a partial or
total disposition plan for the former Hamakua Sugar Company, Inc. lands now under
County ownership in accordance with Chapter 2, Article 19, Real Property
Disposition, Hawaii County Code. Said plan shall include but is not limited to the
following elements:
1. To lease or sub-lease a portion of the most important agricultural lands
which includes but is not limited to lands located at Koholalele, Paauilo
and Pohakea for diversified agriculture, eco-tourism and pastoral use;
2. To exchange a portion of the approximately 4,400 acres of land on a
value-for-value basis for purposes of expanding existing
County-priority parks, roads, water projects or other infrastructural
systems or facilities; and
3. To sell a portion of the approximately 4,400 acres of land; and
WHEREAS, to reformulate a partial or total disposition plan, the
Administration is reviewing various proposals which have been submitted for
consideration; and
WHEREAS, Winkler Wood Products, Inc. (Winkler) has submitted a request
for a license to harvest Cook Pine (Araucaria columnaris) and various Eucalyptus
species (Eucalyptus spp.) from and to replant Cook Pine seedlings on a 40.0 acre ±
portion of Tax Map Key: 3ro/4-8-03:05 situate at Waikoekoe, Hamakua, Hawaii
(Exhibit "A"); and
WHEREAS, Winkler is a locally owned lumber business that logs, mills, crafts
and sells various local and exotic woods and wood products to wood turners,
artisans, collectors, contractors and do-it-yourselfers; and
WHEREAS, Winkler proposes to harvest the Cook Pine and various
Eucalyptus species, principally, for turning stock to meet the demands of bowl
turners, artisans and other users; and
WHEREAS, Winkler proposes to manage the timber stand as a sustainable
forest project to insure the constant and consistent supply of the resource; and
WHEREAS, the proposed project description, the potential effects of the
proposed project and their mitigation measures were discussed in an Informational
Document prepared for this disposition; and
WHEREAS, Section 2-119, Hawaii County Code, provides that the Council
may, after consulting with the Chief Engineer, direct the Finance Director to issue
licenses and permits through negotiation and without public auction for the
temporary occupancy of County owned lands under such conditions which will best
serve the interest of the County, subject, however, to such restrictions as may from
time to time be expressly provided by law.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII, that the Finance Director or his authorized representative, is
hereby authorized to issue a license to Winkler Wood Products, Inc. for the
harvesting of Cook Pine (Araucaria columnaris) and various Eucalyptus species
(Eucalyptus spp.) from and for the replanting of Cook Pine on a 40.0 acre + portion
of Tax Map Key: 3`d/4-8-03:05 situate at Waikoekoe, Hamakua, Hawaii. Said
harvesting and replanting shall be conducted in a manner consistent with the
methods and procedures described in the Informational Document which was
prepared for this disposition and which will be appended to the license document, in
addition to such other terms and conditions which will best serve the interest of the
County of Hawaii.
BE IF FURTHER RESOLVED that the Clerk of the County of Hawaii shall
transmit copies of this resolution to the Honorable Stephen K. Yamashiro, Mayor of
the County of Hawaii and Mr. Edward Winkler, President of Winkler Wood
Products, Inc.
