Resolution
WHEREAS, the demonstration at the Hilo Airport by 53 people
on September 4, 1978, was generally a peaceful one void of any
injury to anyone or major adverse incident; and
WHEREAS, these demonstrators both young and old believed
that this method was the only effective way to attract atten-
tion to the problems that they felt were discriminatory .to the
Hawaiian people; and
WHEREAS, the potential punishment to these people are
fines of $1,000 and one year in jail for each of them for their
alleged violation; and
WHEREAS, such a penalty appears to be too harsh in light
of more serious demonstrations or strikes by governmental and
other untions which have in the past closed down our seaports
and stopped or stalled public safety services such as police
and fire protection without penalty,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that it requests that the Court in its judicial wisdom
look upon this case as an expression by a group of people to
exercise their cherished freedom to congregate and state their
views, and thereby dismiss the entire case.
BE IT FURTHER RESOLVED that the Clerk of the County of
Hawaii remit true copies of this resolution to Judge Paul M.
de Silva of the South Hilo District Court and to Governor
George Ariyoshi.
