RESOLUTION NO. 106 99
RESOLUTION AUTHORIZING THE TRANSFER OF REAL PROPERTY LOCATED
AT THE INTERSECTION OF KUAKINI HIGHWAY AND KAMEHAMEHA III
ROAD FROM THE COUNTY OF HAWAII TO THE STATE OF HAWAII.
WHEREAS, Kuakini Highway, owned by the State of Hawaii, and Kamehameha
III Road, owned by the County of Hawaiii, intersect in the North Kona District; and
WHEREAS, Kamehameha Investment Corporation, an adjacent property owner,
plans to improve the intersection to upgrade the safety and visual appearance of the
roadway by widening and extending the acceleration and deceleration lanes, widening
turns, upgrading the traffic islands, restriping the roadway and landscaping the
intersection; and
WHEREAS, the State of Hawaii and the County of Hawaii wish to reconfigure the
Kuakini Highway right-of-way at Kamehameha III Road to properly conform the
property boundaries with the State's and County's jurisdiction over the intersection
improvements; and
WHEREAS, this requires the transfer of land from the County of Hawaii to the
State of Hawaii; and
WHEREAS, Section 2-120(a)(1) of the Hawaii County Code permits the sale in
fee simple of real property owned by the County of Hawaii to other government or
governmental agencies authorized to hold real property in fee simple.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII THAT: The Director of Finance is hereby directed to, pursuant
to Section 2-120 of the Hawaii County Code to negotiate the sale of the County of
Hawaii's fee simple interest in that property consisting of Parcel 2 of Tax Map Key
7-8-010 to the State of Hawaii in order to accomplish the desired realignment of the
roadway.
BE IT FURTHER RESOLVED that the County Clerk be and is hereby directed
and instructed to forward a copy of this resolution to the Director of Finance, the Mayor
of the County of Hawaii, and the Department of Public Works, and that the Director of
Finance be and is hereby authorized to make the necessary transfers in accordance with
the terms of this resolution.
