NOES: Councilmembers Chung, Ela ionoff, Jacobson Leithead-Todd, Pisicchio, Snith, Tyler and Yagong - 8. ge: Res. 119-99 (Draft 2)/C-382/FC-118 COUNTY OF HAWA.~,I: STATE OF HAWAII RESOLUTION No. 1.19 99 (DRAFT 2) RESOLUTION OF THE COUNCIL OF THE COUNTY OF HAWAII AUTHORIZING THE ACQUISITION OF THE "ICE HOUSE" BY LAND EXCHANGE, TAX MAP KEY: 3RD/2-1-03:24 BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII: WHEREAS, Mauna Kea Agronomics, Inc. is the owner of Tax Map Key: 3`d/2-1-03:24, more commonly referred to as the "Ice House' (Exhibit "A"); and WHEREAS, the owner has submitted a petition to the Hawaii Redevelopment Agency (HRA) to re-designate the subject site from Open to a Commercial-Limited Industrial Use designation; and WHEREAS, re-designation of the property will permit the owner to construct a second story addition over the "Ice House' which will house a restaurant with banquet facilities and a museum about the history of the Waiakea Peninsula prior to the tsunami of May 23, 1960 and to also construct a three story addition which will have covered parking on the ground level, commercial office space and transient accommodations on the second and third stories, respectively; and WHEREAS, at the various HRA meetings, members of the public, including the Hilo Outdoor Circle, have voiced their opposition to the petition for re-designation and the proposed construction as being invasive to the passive tranquility of Liliuokalani Gardens; and -1- WHEREAS, public testimony has suggested that to insure the rights of the property owner and to maintain the peaceful ambiance of the Liliuokalani Gardens, that the County of Hawaii or the State of Hawaii should acquire the "Ice House" property by purchase or land exchange; and WHEREAS, after considerable discussion and upon a motion duly moved and seconded, the HRA, at its meeting of March 16, 1999, voted unanimously to recommend that the County of Hawaii explore the possible acquisition of the "Ice House" through a land exchange (Exhibit "B"); and WHEREAS, the owner has expressed an interest in negotiating a land exchange for available County of Hawaii lands. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, through its authority under Section 2-111, Hawaii County Code, that it authorizes the Finance Director or his authorized representative, subject to the provisions of Section 2-115, Hawaii County Code, to enter into negotiations with Mauna Kea Agronomics, Inc., for the acquisition of the "Ice House", further identified as Tax Map Key: 3'"/2-1-03:24, by land exchange, on a value for value basis, for so much of the available County of Hawaii owned properties as necessary[.] exclusive of Tax Map Kev: 3~d/7-5-04:63: subject to the following: a. Upon completion of the negotiations for the land exchange, the Finance Director shall submit a report to the Council of the County of Hawaii. Said report shall include but not be limited to (I) Identification by Tax Map Keys of the parcels being exchanged: (ii) The area of the parcels being exchanged; (iii) Value of the -2- parcels being exchanged: (iv) The name or names of the appraiser or appraisers: and (v) The date of the appraisal report or reports: and b. The Council of the County of Hawaii shall have the right to disapprove the negotiated land exchange, provided, said disapproval is adopted by the Council of the County of Hawaii within sixty (60) days of receipt of the aforementioned report. BE IT FURTHER RESOLVED that a copy of this resolution be transmitted to the Honorable Stephen K. Yamashiro, Mayor of the County of Hawaii, Harry A. Takahashi, Director of Finance, Mr. David Reed, Chairman of the Hawaii Redevelopment Agency and Mr. Paul J. Kierkiewicz, President of Mauna Kea Agronomics, Inc. It was felt that if a land exchange could be made, the site could be restored as part of Liliuokalani Park, which would be a more appropriate use for the azea. Thus, the Hawaii Redevelopment Agency is hereby requesting that you explore the possibility of a land exchange for the ice plant site, which may ultimately work to the advantage of all parties involved.
