SUBJECT: Proposed Amendment to Resolution 221-09, Accepting the Dedication of Road
Lots 47 thru 50 of the Hualalai Vistas Subdivision, to the County of Hawaii.
Attached please find a housekeeping amendment in the title of Resolution No. 221-09.
Resolution No. 221-09 is amended as indicated below. Ramseyer format is applied with respect
to the contents of Resolution No. 221-09; material to be deleted is bracketed and stricken
through, material to be added is underlined.
The title to Resolution 221-09 is amended to read as follows:
"RESOLUTION ACCEPTING THE DEDICATION OF ROAD LOT 47 (AKAMAI
STREET), ROAD LOT 48 (ANIANI STREET), ROAD LOT 49 (ALOHA PLACE),
AND ROAD LOT 50 (ANIANI STREET), OF HUALALAI VISTAS SUBDIVISION,
BEING TAX MAP KEY: (3) 7-3-007:027, SITUATE AT KOHANAIKI, DISTRICT OF
NORTH KONA[~4], COUNTY AND STATE OF HAWAII, FROM HUALALAI

RESOLUTION ACCEPTING THE DEDICATION OF ROAD LOT 47 (AKAMAI STREET),
ROAD LOT 48 (ANIANI STREET), ROAD LOT 49 (ALOHA PLACE), AND ROAD LOT 50
(ANIANI STREET), OF HUALALAI VISTAS SUBDIVISION, BEING TAX MAP KEY: (3)
7-3-007:027, SITUATE AT KOHANAIKI, DISTRICT OF NORTH KONA, COUNTY AND
STATE OF HAWAII, FROM HUALALAI VISTA, LLC.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, Hualalai Vista, LLC is the owner of:
Road Lot 4T Akamai Street 3.311 acres
Road Lot 48 Aniani Street .410 acre
Road Lot 49 Aloha Place .937 acre
Road Lot 50 Aniani Street .639 acre
identified as Tax Map Key: (3) 7-3-007:027, situate at Kohanaiki, in the District of North Kona,
County and State of Hawaii; as delineated on Exhibit "A" attached hereto; and
WHEREAS, Hualalai Vista, LLC has constructed all subdivision improvements and
received final subdivision'approval; and
WHEREAS, Hualalai Vista, LLC is desirous of dedicating the above roadway lots,
including all subdivision improvements thereon, to the County of Hawaii for road and drainage
purposes, and the improvements have been inspected and approved by the County of Hawaii
Department of Public Works, Department of Water Supply, Planning Department and
Department of Environmental Management; and
WHEREAS, the subject roads and drainage improvements have been completed
according to County of Hawaii standards, and are in acceptable condition for dedication, and in
full compliance with the provisions of Chapter 23 of the Hawaii County Code; and
WHEREAS, Section 23-10 of the Hawaii County Code prohibits the Council from
receiving by dedication any streets in any subdivision platted after December 2, 1966 except
upon full compliance with the provisions of Chapter 23; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the
council may accept gifts, which include the dedication of land, on behalf of the County of
Hawaii.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it finds the subject subdivision and improvements thereon are in full compliance
with the provisions of Chapter 23 of the Hawaii County Code as certified and approved by all
applicable agencies.
BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII,
in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, and Section 23-10
of the Hawaii County Code, that the County of Hawaii accepts the dedication of
Road Lot 47 Akamai Street 3.311 acres
Road Lot 48 Aniani Street .410 acre
Road-Lot 49 Aloha Place .937 acre
Road Lot 50' Aniani Street .639 acre
identified as 1'ax Map Key: (3) 7-3-007-027, delineated on Exhibit "A" attached hereto,
including all improvements thereon, for public road and drainage purposes.
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) the
Mayor; (2) the Departmentof Public Works; (3) Deputy Corporation Counsel Gerald Takase;
and (4) R. Triantos, Esq., Carlsmith Ball LLP, P.O. Box 686, Hilo, Hawaii 96720, attorneys for
