Resolution No. 321 02
WHEREAS, Senator Claiborne Pell (D -RI) and Congressman
Michael D. Barnes (D -Md) introduced H. R. 2488, which encourages
each State to co-ordinate a comprehensive Alcohol -Traffic Safety
Program in close co-operation with local communities, to deter
drunk driving and to punish and rehabilitate those convicted of
this act and making the State's adherence to the provisions of the
bill as a condition of receiving its annual Federal Highway Safety
Funds; and
WHEREAS, State programs set up in accordance with this Federal
legislation would:
*For first offenders, require a mandatory sentence of at least 10 -days
community service, in addition to fines and participation in traffic
safety or alcohol treatment programs;
*For repeat offenders (persons convicted of drunk driving two or more
times within a five-year period), require a mandatory sentence of at
least 10 -days imprisonment or community service, or both, in addition
to fines and participation in alcohol treatment programs;
*For first offenders, require a mandatory suspension of the driving
privilege by the state licensing agency for up to one year with a
provision for a restricted license;
*For repeat offenders, require a mandatory revocation of driving
privilege by the state licensing agency for not less than one year;
*Set up a statewide driver record system capable of identifying repeat
offenders that is easily accessible to the courts;
*Require a uniform standard definition of intoxication at a blood-alcohol
concentration level no higher than .10 per cent;
*Include adequate enforcement and public information efforts, efficient
arrest and adjudication procedures, monitoring to assure compliance
with court sanctions, and pre -sentence screening of offenders for
sanctioning purposes; and
WHEREAS, Senate Bill 2147-82, amending HRS -291-4, driving under
influence of intoxicating liquor, containing the Federal mandate
required of each state, was introduced by Senator Mary George at the
Eleventh Legislature 1982; and
WHEREAS, the statistics provided by the National Highway Traffic
Safety Administration and the National Safety Council summarizes that:
*One quarter of a million Americans lost their lives in alcohol-related
auto crashes over the past decade;
*One American life is lost every 21 minutes in alcohol-related auto..
crashes;

*750,000 Americans suffer crippling and other serious injuries
every year in drunk driving incidents;
*#1 cause of death for Americans up to age 35 and more than half
of highway deaths are caused by drunk drivers;
*On an average weekend night, one out of every 10 drivers on the
road is drunk;
*65% of drivers who kill themselves in single -car wrecks are drunk;
*0£ every 2,000 drunken drivers, only one is arrested;
*44% of all.nighttime fatal alcohol-related crashes are caused by
the 16 to 24 age group (this group comprises only 22% of the total
licensed population);
*Drunk driving is responsible for the most common form of violent
death in the nation.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it urges the passage of Senate Bill 2147-82 at the 11th
Legislature 1982, amending HRS 291-4, "DRIVING UNDER INFLUENCE OF
INTOXICATING LIQUOR" which provides, for fines up to $1,000.00, 10 days
community service, driver's license suspension, not less than 10 days
imprisonment, revocation of driver's license for one year.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii is
instructed to transmit true copies of this resolution to Senate
President Richard Wong, Speaker of the House Henry Peters and to
Senator Mary George, Chairperson of the Senate Transportation Committee.
