Resolution No. 3,11 82
WHEREAS, Chapter 2, Article 9, Section 2.A Hawaii County
Code, as amended, provides.that the County Council may by
resolution approved by a majority of its members, direct the
Director of Finance to issue permits for the temporary
occupancy of County -owned lands; and
WHEREAS, the property owned by the County of Hawaii
(adjacent to the former Ookala School) situated at Ookala;
Hawaii TMK: 3-9-01:26 containing an area of .363 acres, is not
being utilized and is considered surplus to County needs; and
WHEREAS, Theo. H. Davis & Co., Ltd; dba Davies Hamakua
Sugar Company, hereinafter referred to as "Plantation" desires
to utilize the hereinabove described property to expand its
factory operation; and
WHEREAS, the County Council approved Resolution No. 138,
dated July 22, 1981 to Plantation, authorizing the Director of
Finance to issue a month-to-month permit expiring on December 31,
1981 for the temporary use of the land; and
WHEREAS, the Director of Finance requires additional time
to negotiate the exchange of land with Plantation;
NOW, THEREFORE, BE IT RESOLVED by the Council of the County
of Hawaii that, in accordance with the provisions of Chapter 2,
Article 9, Section 2.A of the Hawaii County Code, as amended,
the Director of Finance be authorized to issue an extension of
a month-to-month permit to Plantation expiring on June_30, 1983
for the temporary use of the land for expansion of its factory
operations. The Director of Finance shall determine terms and
conditions of the permit.

BE IT FURTHER RESOLVED that prior to the expiration
date of the temporary permit the Director of Finance shall
dispose,of the property by exchange, as provided in
Article 9, Chapter 2, of the Hawaii County Code.
