RESOLUTION ACCEPTING THE DEDICATION OF HO'OHOALOHA STREET WITHIN
THE WAIAKEA ACRES II SUBDIVISION FROM WILLIAM V. BRILHANTE, TRUSTEE,
MELVIN CECIL MORRIS, BRENDA JOYCE MORRIS AND CHRIS BRILHANTE, TAX
MAP KEY (3)2-4-034-042, TO THE COUNTY OF HAWAII.
WHEREAS, WILLIAM V. BRILHANTE, Trustee, MELVIN CECIL MORRIS and
BRENDA JOYCE MORRIS, husband and wife, and CHRIS BRILHANTE, the developers of the
Waiakea Acres II Subdivision, and the owners of Ho'ohoaloha Street located in Waiakea,
District of South Hilo, County and State of Hawaii, specifically identified as Tax Map
Key (3)2-4-034-042, being more particularly described in Exhibit A and delineated on Exhibit B
attached hereto; and
WHEREAS, the above-mentioned developers have constructed all subdivision
improvements as required for final subdivision approval; and
WHEREAS, the above-mentioned developers have received approval from the County of
Hawaii's Department of Public Works, Department of Water Supply and the Planning
Department for the improvements made to the subject property, and are desirous of dedicating
the subject road to the County of Hawaii for road and drainage purposes; and
WHEREAS, the subject road and drainage improvements have been completed according
to County of Hawaii standards and are in acceptable condition for dedication in compliance with
Chapter 23, Hawaii County Code; and
WHEREAS, Section 23-10 of the Hawaii County Code requires that the acceptance of
such road and drainage improvements be in compliance with Chapter 23 of the subdivision code;
and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the
Council may accept gifts which include the dedication of land on behalf of the County of Hawaii;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, and
Section 23-10 of the Hawaii County Code, that the County of Hawaii accepts the dedication deed
for Ho'ohoaloha Street identified as Tax Map Key (3)2-4-034-042 for road and drainage
purposes.
