HomeMy WebLinkAboutRES 135 Draft 01 1998-2000 OFFICE INFORMATION ONLY Meeting: Hawaii County Council -October 14, 1999 Action: Close file Re: Res. 135-99/C-419/CF-127 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 135 S9 RELATING TO THE SALE OR LEASE OF PROPERTIES PURCHASED THROUGH THE GEOTHERMAL RELOCATION PROGRAM BY NEGOTIATIONS WHEREAS, the Council of the County of Hawaii adopted Article 36 of Chapter 2, Hawaii County Code effective January 24, 1996, relating to the establishment of a Geothermal Relocation Program; and WHEREAS, the Council of the County of Hawaii authorized the Planning Department to establish a geothermal relocation program for the relocation ofowner-occupants residing near the Puna Geothermal Venture's facility; and WHEREAS, the Planning Department adopted its Rule 10 relating to Geothermal Relocation Program effective July 8, 1996; and WHEREAS, the Planning Department's Rule 10 states that the Planning Director may solicit the assistance of a qualified real estate appraiser and/or real estate broker to assist in implementing the procedures for the relocation of the affected owner-occupants, including the negotiation, purchase, and sale of the affected dwellings and properties; and WHEREAS, Section 2-178, Article 36, Chapter 2, Hawaii County Code authorizes the Planning Director to purchase the affected dwellings and properties by negotiation and also dispose of the affected properties by public auction pursuant to Article 19 of Chapter 2, Hawaii County Code; and WHEREAS, the County of Hawaii purchased three properties identified by Tax Map Keys 1-3-46:60 & 61 and 1-3-44:27; and WHEREAS, the Planning Director consulted with expert real estate appraisers and brokers retained by the County to assist in the purchase and sale of the geothermal relocation properties and said appraisers and brokers have advised her that due to the unique location of the properties that a sale by negotiation would be likely to bring a better price than a sale by auction. Therefore, the Planning Director believes that sale by negotiation would be in the public interest. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds it to be in the public interest to allow a sale by negotiation. BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii transmit copies of this resolution to the Honorable Stephen K. Yamashiro, Mayor of the County of Hawaii; Virginia Goldstein, Planning Director; Harry Takahashi, Finance Director; and Richard Wurdeman, Corporation of the County of Hawaii.
