HomeMy WebLinkAboutRES 138 Draft 02 1998-2000 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO~'3~ 99 (DRAFT 2) RESOLUTION ACCEPTING THE GRANT OF EASEMENT AND BILL OF SALE FROM THE CASEY FAMILY PROGRAM, TAX MAP KEY (3)2-3-035:038 (PORTION), TO THE COUNTY OF HAWAII. WHEREAS, The Casey Family Program, a Washington corporation, is the owner of a drywell located at Tax Map Key (3)2-3-035:038, being more particularly described in Exhibit A and delineated on Exhibit B attached hereto; and WHEREAS, the subject drywell has been constructed to meet dedicable standards required for final acceptance; and WHEREAS, The Casey Family Program has received approval from the County of Hawaii's Department of Public Works, Department of Water Supply and the Planning Department for the drywell improvements made to the subject property, and aze desirous of dedicating the drywell to the County of Hawaii for drainage purposes; and WHEREAS, the subject drainage improvements have been completed according to County of Hawaii standards and are in acceptable condition for dedication in accordance with Chapter 23, Hawaii County Code; and WHEREAS, Section 23-10 of the Hawaii County Code requires that the acceptance of such drainage improvements be in compliance with Chapter 23 of the subdivision code; and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the Council may accept gifts which include the dedication of drainage improvements on behalf of the County of Hawaii; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, and Section 23-10 of the Hawaii County Code, that the County of Hawaii accepts the grant of easement and bill of sale for the drywell improvements identified on Tax Map Key (3)2-3-035:038 for drainage purposes. P. on Confirmation 1946, Number 1 to D. B. Lyman, Land Commission Award 387, Part 4, Section 1 to American Board of Commissioners for Foreign Missions. Being also a portion of Lot 13-A. Beginning at the east corner of this easement and along the northwesterly side of Pu'uhonu Place, the direct azimuth and distance from the east corner of Lot 13-A being: 57° 49' 7.58 feet, the coordinates of said point of beginning referred to Government Survey Triangulation Station "HALAI", being 102.59 feet South and 371.03 feet West, thence running by azimuths measured clockwise from true South: 1. 57° 49' 15.00 feet along Pu'uhonu Place; 2. 147° 49' 15.00 feet along the remainder of R.
