HomeMy WebLinkAboutRES 308 Draft 01 1980-1984E County of Hawaii—State of Hawaii Resolution No. 308 82 WHEREAS, the construction of the Four Mile Creek portion (Phase II) of the Waiakea Uka Flood Control Project has been completed by the County of Hawaii; and WHEREAS, Parcels A-1 and A-2, delineated in red on Exhibit "A" attached hereto and made a part hereof, are remnant parcels and no longer required by the County because of a change in location of the maintenance access road; and WHEREAS, Parcels A-1 and A-2 were originally acquired from Mr. Hiromu Yamanaka after direct access from Kanoelehua Avenue could not be obtained; and WHEREAS, Mr. Hiromu Yamanaka's cooperation in the acquisition of Parcels A-1 and A-2 at 18 cents per square foot in 1978 resulted in a 480 feet reduction in length of the channel protection fencing and a savings of $7,800 in cost; and WHEREAS, Mr. Hiromu Yamanaka is the owner of the property abutting remnant Parcels A-1 and A-2, and he desires to reacquire said parcels; and WHEREAS, in the reacquisition of Parcels A-1 and A-2, Mr. Hiromu Yamanaka would make Parcel A-3 available to the County to eliminate the jog in the property boundary; and WHEREAS, Chapter 2, Article 9, Section 9B, Hawaii County Code, as amended, provides for sale of any remnant or portion thereof to the abutting owner; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that pursuant to Chapttr 2, Article 9, Section 2 of the Hawaii County Code, as amended (Disposition of Real Property Owned by the County of Hawaii), it approves and authorizes the Director of Finance to dispose of remnant Parcels A-1 and A-2 to Mr. Hiromu Yamanaka at appraised value but considering the value of Parcel A-3 to be acquired by the County and the $7,800 savings realized by the County upon the original acquisition of Parcels A-1 and A-2; BE IT FURTHER RESOLVED that the County Clerk be authorized and directed to send a copy of this Resolution to the Chief Engineer and the Director of Finance of the County of Hawaii.
