Resolution
WHEREAS, Chapter 2, Article 9, Hawaii County Code, as amended,
provides that the County Council may by resolution approved by a
majority of its members, exchange of County -owned property for
private property for public purposes;
WHEREAS, a portion of the County maintained road at Paauilo-
Pohakea Homestead Road situated at Manienie, Hamakua, Hawaii, TMK:
4-3-03,04 & 07, is not within the government road right-of-way
(designated as road remnant and shaded in red on attached map) but
encroaches upon lands owned by Davies Hamakua Sugar Company
(designated as parcel 3 & 4 and shaded in yellow on attached map);
WHEREAS, the purpose of land exchange between Davies Hamakua
Sugar Company, and the County of Hawaii is to define and establish
the property line of County maintained road;
WHEREAS. County of Hawaii will convey in fee simple to Davies
Hamakua Sugar Company, road remnant containing an area of 20,146
sq. ft. and, in return, Davies Hamakua Sugar Company will convey in
fee simple, to the County of Hawaii parcels 3 & 4 of land containing
total area of 24. 677 sq. ft.;
WHEREAS, it is mutually agreed between Davies Hamakua Sugar
Company, and the County of Hawaii that no monetary consideration
shall be involved in the exchange;
WHEREAS, the State of Hawaii has conveyed road remnant to the
County to effectuate the exchange;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it approves and authorizes the Mayor to enter into a
land exchange with Davies Hamakua Sugar Company;
BE IT FURTHER RESOLVED that the County Clerk be authorized and
directed to forward a copy of this Resolution to Davies Hamakua Sugar
Company, and to the Department of Public Works and the Director of
Finance of the County of Hawaii.
