RESOLUTION NO. 144 99
RESOLUTION OF THE COUNTY COUNCIL OF THE COUNTY OF HAWAII
AUTHORIZING THE EXEMPTION OF CERTAIN ZONING CODE REQUIREMENTS,
PURSUANT TO SECTIONS 201G-118 AND 201G-113 OF THE HAWAII
REVISED STATUTES FOR THE PROPOSED HUALALAI ELDERLY LOW INCOME
HOUSING PHASE II RENTAL HOUSING PROJECT.
WHEREAS, the Hawaii Island Community Development
Corporation (hereinafter "HICDC"), an island wide based non-
profit entity, has been working to develop an affordable rental
housing project for the elderly (hereinafter "Hualalai Elderly -
Phase II") on land at Kailua, Kona, Hawaii identified as
TMK:3/7-5-10: portion of 7, to provide decent, safe and sanitary
housing to qualified senior citizens of the County of Hawaii
(hereinafter "County"); and
WHEREAS, The Office of Housing and Community Development
(hereinafter "OHCD") has been working with the HICDC to develop
this project; and
WHEREAS, the County and HICDC mutually desire to develop
affordable rental housing units to senior citizens with income
levels of 60 per cent (60$) and below of the median family
income for the County of Hawaii; and
WHEREAS, the OHCD has determined that (1) the HICDC is an
acceptable and eligible developer in satisfaction of the
requirements of Chapter 201G of the Hawaii Revised Statutes;
and (2) the Kailua area is a good and proper choice for housing
development and construction; and
WHEREAS, the County and HICDC will be entering into an
agreement to develop the Hualalai Elderly Phase II rental
housing project; and
WHEREAS, HICDC will be applying for the use of State and
Federal Low Income Housing Tax Credits Program funds. HICDC is
also proposing to utilize the U. S. Department of Agriculture
Rural Development Rural Rental Housing Program Section 515
Program as another source of funding for the project; and

WHEREAS, the preliminary plans submitted for the Hualalai
Elderly Phase II affordable rental housing project are attached
hereto as "Exhibit A"; and
WHEREAS, to enable the Hualalai Elderly Phase II rental
housing project to remain affordable, as defined by the
Affordable Housing Policy for the County of Hawaii, the OHCD is
proposing to utilize Sections 201G-118 of the Hawaii Revised
Statutes, which allows certain housing projects to be exempt
from certain laws and rules, provided the County Council
approves; and
WHEREAS, the Hualalai Elderly Phase II will promote the
goals contained in Sections 201G-113 and 118, of the Hawaii
Revised Statutes, and in Chapter 2, Article 13, of the Hawaii
County Code.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, that preliminary plans for the Hualalai Elderly
Phase II rental housing project site are hereby approved as
attached hereto as "Exhibit A."
BE IT FURTHER RESOLVED, that pursuant to provisions of
Section 201G-118(a)(3)(C) of the Hawaii Revised Statutes, that
the Mayor of the County of Hawaii or his duly authorized
representative shall be the responsible County official who will
certify maps and plans of lands connected with the Hualalai
Elderly - Phase II rental housing project as having complied
with applicable laws and ordinance relating to the zoning-
parking requirements.
BE IT FURTHER RESOLVED that the Mayor of the County of
Hawaii or his duly authorized representative is hereby
authorized to execute an agreement with the Hawaii Island
Community Development Corporation to further the development of
the Hualalai Elderly - Phase II rental housing project.
BE IT FURTHER RESOLVED, that the Mayor of the County of
Hawaii or his duly authorized respresentative is hereby
authorized to execute other documents required to develop the
Hualalai Elderly - Phase II rental housing project.
BE IT FURTHER RESOLVED, that the agreement between the
Hawaii Island Community Development Corporation and the County
of Hawaii, reflect a sunset date for the exemptions of not more
that two (2) years from the date of this Resolution if the
project is not developed.

BE IT FURTHER RESOLVED, that a copy of this resolution be
transmitted to the Hawaii Island Community Development
Corporation, the Planning Director of the County of Hawaii, and
the Office of Housing and Community Development.

"EXHIBIT a"
Hualalai Low-Income Housing Project Phase II
Pursuant to Section 201G-118, HRS, the following exemptions
from laws, code requirements and standards, as established
by the Department of Public Works, are requested:
1. Zoning Code: County- Agriculture One Acre (A-la)
Exemption requested: County rezoning from
Agriculture One Acre (A-la) to Multi-family
Residential Eour Thousand (RM-4).
2. Subdivision Code:
Exemption requested: That preliminary subdivision
plans attached as Exhibit "A" be granted final
subdivision approval.
3. Zoning Code:
Exemption requested: That the required number of
parking spaces be reduced from one and one
quarter (1.25) per unit to one (1.0) per unit.
4. Application Fees:
Exemption requested: Waiver of the subdivision
application fee.
