RESOLUTION NO. 155 93'
RESOLUTION ACCEPTING THE DEDICATION OF ROAD REMNANT LOT IN THE
KUWAHARA SUBDIVISION, TAX MAP KEY (3)1-5-001:065, SITUATE AT KAOHE
HOMESTEADS, PUNA, HAWAII, TO THE COUNTY OF HAWAII.
WHEREAS, Alan A. Kuwahara and Lynne Kuwahaza, husband and wife, and James S.
Kuwahara and Doris Y. Kuwahara, husband and wife (hereinafter collectively "the Kuwahazas"),
aze the owners of that certain road remnant lot located in Puna, Hawaii, specifically identified as
Tax Map Key (3)1-5-001:065, being more particularly described in Exhibit A and delineated on
Exhibit B attached hereto; and
WHEREAS, the cun-ent County-maintained roadway encroaches into the Kuwaharas'
property; and
WHEREAS, it was agreed by the Planning Department, the Department of Public Works,
and the Kuwaharas as part of subdivision approval that the improved road remnant lot, consisting
of 1.688 acres and containing the County-maintained road, be dedicated to the County of Hawaii;
and
WHEREAS, this dedication of land would eliminate any encroachment and relieve the
existing landlocked pazcels to the north; and
WHEREAS, final subdivision approval was granted on April 15, 1999; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter provides that the
Council may accept gifts which include the dedication of land on behalf of the County of Hawaii.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, that the
County of Hawaii accepts the warranty deed for the road remnant lot identified as Tax Map Key
(3)1-5-001-065 for road and drainage purposes.
BE IT FURTHER RESOLVED that copies of this resolution shall be forwarded to:
(1) Jerel I. Yamamoto, Esq., 187 Kapiolani Street, Hilo, Hawaii 96720; (2) Director of Finance;
(3) Department of Public Works; and (4) Gerald Takase, Deputy Corporation Counsel, who will
record said deed.

Subdivision of Lot 11-C of Kaohe Homesteads
(Being a Portion of Grant 4769 to H. Piper)
Situated at Kaohe Homesteads, Puna, Island of Hawaii, Hawaii
Beginning at the easterly corner of this parcel of land, being also the initial point of Lot
11-C-I, the coordinates of said point of beginning referred to Government Survey
Triangulation Station "PUAAKOKOKE" being 10,082.50 feet South and 444.56 feet East
and running by azimuths measured clockwise from True South:
1. 44° 30' 211.01 feet a]ong Lot 11-C-1;
2. 46° 50' 617.45 feet along Lots ] I-C-1 to I I-C-S;
3. 58° 30' 89.52 feet along Lots 1 1-C-5 and 11-C-6;
