Resolution No. 52 si
WHEREAS, pursuant to Chapter 2, Article 9, of the Hawaii
County Code, the County Council may dispose of real property
by granting an easement for particular purposes, subject to
reverter to the County upon termination or abandonment of the
specific purpose for which it is granted, provided that any
easement may be granted by direct negotiation and without
recourse to public auction when the sale price of such easement
is less than $1000.00; and
WHEREAS, Hawaii Electric Light Company, Inc., pian to
construct an utility anchor as shown on Helco drawing
No_ 81-A-180; and
WHEREAS, Hawaii Electric Light Company, Inc., has applied
for a grant of easement over Parcel "I", being a portion of
grant 13034, TMK: 2-2-48-87. Said easement being three (3)
feet wide and extending within said Parcel "I", as more
particularly shown in red on Hawaii Electric Light Company, Inc.'s
drawing No. 81-A-180, attached hereto and by reference made
a part hereof; and
WHEREAS, the granting of the easement will have no adverse
effect on the operation, repair or maintenance of the Waiakea Uka
Flood Control by the County; and
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that it directs the Finance Director of the County of
Hawaii or his authorized representative to dispose of the ease-
ment area, as described hereinabove, by direct negotiation and
without recourse to public auction in accordance with Chapter
2, Article 9 of the Hawaii County Code.

BE IT FURTHER RESOLVED that the Director of Finance grant
the easement area for the nominal sum of $1.00.
BE IT FINALLY RESOLVED that the Clerk of the County of Hawaii
send copies of this resolution to Hawaii Electric Light Company,
Inc., the Mayor, the Director of Finance and the Chief Engineer
of the County of Hawaii
