RESOLUTION No. 385
RESOLUTION AUTHORIZING THE ABANDONMENT AND DISPOSITION OF A
PORTION OF THE OLD GOVERNMENT ROAD SITUATE AT MAKAPALA,
NORTH KOHALA, HAWAII
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
WHEREAS, the County of Hawaii owns a portion of the Old Government
Road situate at Makapala, North Kohala, Hawaii, which is shown on the survey
map designated C.S.F. No. 21,010 dated July 13, 1989 and labelled Exhibit "A;"
and
WHEREAS, this portion of the Old Government Road is not utilized as a
roadway because of the current alignment of the Main Government Road (Akoni
Pule Highway); and
WHEREAS, all roadways, once established, continue until vacated, closed,
abandoned or discontinued by resolution of the Council; and
WHEREAS, the County of Hawaii finds that this portion of the Old
Government Road is no longer required as a vehicular transportation corridor;
and
WHEREAS, the County of Hawaii finds that this portion of the Old
Government Road is economically and physically unsuitable or undesirable for
development or utilization as a separate unit by reason of its location, size and
shape, and by definition is a remnant in accordance with Section 2-110,
Definitions, Hawaii County Code; and
WHEREAS, the property abutting the aforementioned portion of the Old
Government Road is owned by Robert Carter Moore - 2/5 interest, and
William K. Lum, Ida F. Lum and Stanley F. Lum - 3/5 interest; and
WHEREAS, Mr. Moore, through his attorney, Henry Nakamoto, has
expressed a desire to acquire the aforementioned portion of the Old
Government Road (Exhibit "B"); and
WHEREAS, Section 2-111, Powers of Council, Hawaii County Code, provides
that the Council may direct the Finance Director to dispose of real property in fee
simple; and
WHEREAS, Section 2-118, Remnants, Hawaii County Code, provides that
remnants or portions thereof may be disposed of without recourse to public
auction and shall be first offered for sale to the abutting landowners; and
WHEREAS, Section 2-118(b), Hawaii County Code, provides that in cases
involving parcels of less than two thousand five hundred square feet (2,500 s.f.),
the Finance Director may establish a price which is based on the square foot
value used for determining real property valuations of the abutting owners; and
WHEREAS, the Real Property Tax Division has assessed the abutting
property, Tax Map Key: 3`d/5-2-08:09, at two dollars and fifty cents per square
foot ($2.50/s.f.), therefore, the value of the remnant is $5,847.50.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII, that the aforementioned portion of the Old
Government Road is declared to be abandoned and otherwise a discontinued
right-of-way which is physically and economically unsuitable or undesirable for

development or utilization as a separate unit by reasons of its location, size and
shape and by definition is a remnant in accordance with Section 2-110,
Definitions, Hawaii County Code.
BE IT FURTHER RESOLVED that the Finance Director is authorized to sell
the aforementioned remnant without recourse to public auction in a manner
consistent with Section 2-118, Remnants, Hawaii County Code.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of
this resolution to the Honorable Stephen K. Yamashiro, Mayor of the County of
Hawaii, Harry A. Takahashi, Director of Finance, Robert K. Yanabu, Chief
Engineer and Henry T. Nakamoto, attorney for Robert Carter Moore.
