Resolution
WHEREAS, Section 10-11 of the County Charter requires
that any contract, lease or other obligation requiring payment
of funds from appropriations of a later fiscal year or of more
than one fiscal year be approved by resolution of the Council;
WHEREAS, the City and County of Honolulu will be providing
for all counties certain real property tax services such as
data processing, tax mapping and technical support; and
WHEREAS, the agreement with the City and County of Honolulu
calls for quarterly payments of estimated costs and an annual
adjustment for payment of actual costs to be determined after
the close of the fiscal year;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII:
1. That the contract for real property tax services with
the City and County of Honolulu be approved; and
2. That sufficient funds be provided in future fiscal
years to cover the obligation of the County under this
agreement_

A G R E E M E N T
THIS AGREEMENT made
, 19
and entered into this
day of
, by and between the CITY AND COUNTY
OF HONOLULU, hereinafter called the "CITY", and the COUNTY OF
HAWAII , hereinafter called the "COUNTY".
W I T N E S S E T H:
THAT in consideration of the mutual covenants, terms and
conditions herein contained, theparties hereto agree with each
other as follows:
I
1) The CITY shall furnish and provide the necessary data
processing services to support the COUNTY'S real property tax
system.
2)
The CITY shall
furnish
and provide
tax mapping services
for all
parcels located
in the
COUNTY, which
shall include, among
other things, the abstracting of title transfer records, the
drawing and production of tax maps, and the maintenance of
records and a referral system.
3) The CITY shall furnish and provide full property
technical support services to the COUNTY, including the develop-
ment and maintenance of.building cost factors,.the conduct of
assessment -sales ratio studies, the development and updating
of a valuation manual, review and recommendation on proposed
legislation, training of COUNTY staff, and such other services
as may promote uniform assessment policy and method.
4) All services and material shall be performed and
prepared in a timely manner sufficient to comply with real
property tax requirements applicable to both parties.

AND in consideration of the covenants, terms and conditions
herein contained, the COUNTY hereby covenants and agrees:
1) That the COUNTY shall pay the CITY on or before the
20th
day after the
close of each
of
four (4)
calendar quarters
the
sum of $40,896.00,
provided
that
within
120 days of the
close of the term
of
this
Agreement the CITY shall determine -
the actual costs
for
the
services rendered hereunder, and the
COUNTY agrees that said actual costs shall be the
reement
price.
The costs shall be based on the following rates:
a) Data Processing will be based on actual costs.
b) Tax mapping will be based on the ratio of'the
number of drafting technicians assigned to produce
COUNTY maps to the number of total drafting technicians.
c) Technical support will be based on the ratio
Of COUNTY'S net taxable real property tax valuation to
the statewide net taxable real property tax valuation
for the previous year.
d) The CITY shall provide the COUNTY, upon the
request of the COUNTY, a detailed accounting to show
the computation of its charges.
2) The COUNTY shall indemnify and save harmless the
CITY against any loss or damage arising or proximately result-
ing from the performance of the covenant, terms and conditions
of the AGREEMENT herein except where such Loss or damage arises
or proximately results from the negligence of the CITY.
AND IT IS mutually covenanted and agreed by and between
the parties hereto, as follows:
Full payment by the COUNTY of the AGREEMENT price, as
defined hereinabove, or reimbursement (or credit should the
AGREEMENT continue.in force) by the CITY of any payments made
in excess of said price, shall be made within 12 months of the
close of the term of this AGREEMENT.

That the term of this AGREEMENT shall be for a period of
twelve months commencing July 1, 1981, and ending June 30, 1982,
and shall continue to remain in force from year to year subject
to yearly appropriation and availability of funds.
That the parties hereto shall, upon execution of this
AGREEMENT,
or
immediately thereafter, each
designate
a
repre-
sentative
to
act as liaison officer for the
purpose
of
coordi-
nating the work required to be performed pursuant to this
AGREEMENT.
This AGREEMENT may be terminated by either party provic:ed
that one hundred eighty (180) days written notice is given the
other party. Upon termination the CITY will reproduce all
systems, programming, and operating documentation; provide a
magnetic tape of all source code of programs used in the Real
Property Tax System, and a list of computer configuration
including peripherals and software used by the operating system.
The actual cost of personnel and supplies for such reproduction
and production shall be borne by the COUNTY. Upon request the
CITY shall transfer all tax maps produced by the CITY pursuant
to the terms of this AGREEMENT_
IN WITNESS WHEREOF, the parties hereto have caused this
AGREEMENT to be executed as of the date first written above.
