Resolution
WHEREAS, Chapter 2, Article 9, Section 2.A Hawaii County Code, as
amended, provides that the County Council may by resolution approved by a
majority of its members, direct the Director of Finance to issue permits for
the temporary occupancy of County -owned lands; and
WHEREAS, the property owned by the County of Hawaii (adjacent to the
former Ookala School) situated at Ookala, Hawaii TMK: 3-9-01:26 containing an
area of .363 acres, is not being utilized and is considered surplus to County
needs; and
WHEREAS, Theo. H. Davies & Co., Ltd.; dba Davies Hamakua Sugar Company,
hereinafter referred to as "Plantation" desires to utilize the hereinabove
described property to expand its factory operation; and
WHEREAS, the County Council approved Resolution No. 690, dated October 1,
1980 to Plantation, authorizing the Director of Finance to issue a month-to-month
permit expiring on June 30, 1981 for the temporary use of the land; and
WHEREAS, the Director of Finance requires additional time to negotiate
the exchange of land with Plantation,
NOW, THEREFORE, BE I'T RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII
that, in accordance with the provisions of Chapter 2, Article 9, Section 2.A of
the Hawaii County Code, as amended, the Director of Finance be authorized to
issue an extension of a month-to-month permit to Plantation expiring on December
31, 1981 for the temporary use of the land for expansion of its factory operations.
The Director of Finance shall determine terms and conditions of the permit.
BE IT FURTHER RESOLVED that prior to the expiration date of the temporary
permit, the Director of Finance shall dispose of the property by exchange, as
provided in Article 9, Chapter 2, of the Hawaii County Code.
