Resolution
WHEREAS, pursuant to County Charter Section 3-14 interim amendments
to the Salary Ordinance may be by resolution;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII
that the Salary Ordinance is hereby amended for the following department:
SECTION 8.15. OFFICE OF THE PROSECUTING ATTORNEY.
1. Reallocate one position of Deputy Prosecuting Attorney LS -9 to
Senior Deputy Prosecuting Attorney LS -13.

With the development of the West, Hawaii Office and increasing caseload.
the responsibilities of running a separate office have been added
to this position. Now the West Hawaii Office has a separate budget
so the'Sr. Deputy will be responsible for budget preparation and
projer,tions,,as well as staff needs.

Preparing and maintaining separate budget.

NARRATIVE FOR REALLOCATION OF KONA DEPUTY PROSECUTING ATTORNEY
The West Hawaii Division of the Prosecutor's Office has
been developing since its initial formation in March 1980.
However, with the increase in staff, numerous police referrals
and crime reports, and the acquisition of a separate budget,
the Senior Deputy has many major responsibilities.
Aside from the additional administrative responsibilities,
the Senior Deputy also handles the major felonies and the special
assignments for West Hawaii, and is the representative of the
Prosecuting Attorney for governmental and public relations
matters in the West Hawaii districts.
Our present staff in Kona should be expected to significantly
increase along with the growing needs of the citizenry and requires
personnel of proven legal and administrative abilities. The
Police Department has also expressed their concern for the present
situation in Kona, and the need to retain experienced prosecutors.
Our former West Hawaii Head, Ronald Ibarra, left our office
to join a private firm due to better pay and benefits. However,
if we are able to elevate the present position to the LS -13 rate
($35,160 per annum), we will hopefully be able to attract either
Mr. Ibarra, or someone of his caliber to administer the West
Hawaii Office.
With a few adjustments in our Salaries/Wages Account, we
will be able to fund the reallocated position from unexpended funds
due to vacancies in our office.
We strongly urge you to consider this request to help us
organized and establish a firm foundation for the West Hawaii Office.

The increasing number of cases being referred
to the Career Criminal Unit has necessitated the addition
of another deputy position. Although these'attorneys
handle other cases (e.g. organized crime and ocassional
pinch-hitting for the Main Office), t'he bulk of their
work is concentrating on the career criminal.
These attorneys "specialize in their caseload
and do not carry as heavy a workload as our Main Office
attorneys, who handle everything from traffic violations
to murder trials. By assigning the career criminal cases
to these attorneys, it relieves the Main Office of poten-
tially long jury trials, as well as gives our attorneys
more time'to handle'the'day to day cases. Because the
CCP attorneys have more time to devote to their cases,
their conviction rate is very high.
