RESOLUTION N0. "K
A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO NEGOTIATE
A LEASE OF REAL PROPERTY AT WAIMEA PARK IN SOUTH KOHALA TO THE
SALVATION ARMY, ANON-PROFIT ORGANIZATION, FOR USE AS A SKATE
BOARD PARK.
WHEREAS, the County of Hawaii is the owner of that certain parcel of land
situated a Waimea Park, identified as TMK: (3) 6-5-07:24, and located in South Kohala,
Hawaii: and
WHEREAS, the Salvation Army, anon-profit corporation, desires to establish a
skateboard park upon that property to be used for skateboard practice and competition by
members of the public; and
WHEREAS, §2-120(a)(2) provides that the Council of the County of Hawaii may,
by resolution approved by a majority of its members, direct the Director of Finance
to negotiate the lease of real property to non-profit organizations, without notice or
appraisal as required in Chapter 2, Article 19 of the Hawaii County Code.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII, that the Director of Finance is hereby authorized to negotiate a
lease with the Salvation Army, anon-profit organization, without notice or appraisal, for
a part of the Waimea Park in South Kohala to be used as a skateboard park by the public.
BE IT FURTHER RESOLVED, that the Honorable Stephen K. Yamashiro, Mayor
of the County of Hawaii, is hereby authorized to execute said lease.
BE IT FURTHER RESOLVED, that the Clerk of the County of Hawaii shall
transmit copies of this resolution to the Department of Parks and Recreation of the
County of Hawaii and the Salvation Army.
