Your Committee on Public Works and Intergovernmental Relations, to which was referred
Communication No. 497, regarding Resolution 229-09, reports as follows:
Resolution 229-09, transmitted by Deputy Corporation Counsel Craig T. Masuda, via Communication
No. 497 dated August 18, 2009, authorizes a Grant Easement for Access Purposes to Amy B.H.
Greenwell Ethnobotanical Gardens, Kealakekua, Hawaii
Committee Chair Brenda .1. Ford relinquished her seat to Committee vice Chair Kelly Greenwell.
Sections 2-120(a)(4) and 2-111(2), Hawaii County Code, the Council is authorized to grant easements to
non-profits for particular purposes, subject to reverter to the County of Hawaii upon termination or
abandonment of the specific purpose or closure to the public.
Greenwell Ethnobotanical Gardens Executive Director Peter Van Dyke appeared before Your Committee.
He commented the need to address unsafe curvature in road north of Park entrance and County to address
that concern as soon as possible. Ms. Ford asked for the support of her colleagues on this proposed
resolution.
Your Committee on Public Works and Intergovernmental Relations is in accord with the purpose and
intent of Resolution 229-09, and recommends its adoption.
