Your Committee on Public Works and Intergovernmental Relations, to which was referred
Communication No. 498, regarding Resolution 230-09, reports as follows:
Resolution 230-09, transmitted by Deputy Corporation Counsel Gerald A. Takase via Communication
No. 498 dated August 19, 2009, authorizing the Abandonment of Road Remnant "R"
(Portion of TMK: (3)2-6-010), and Exchange of Real Property with Paulette L. Pang-Ching
(TMK: (3)2-6-010:39), and Lawrence S. Ojiri and Gwen S. Ojiri (TMK: (3)2-6-010:079), situate at
Kaiwiki, South Hilo, Hawaii.

Committee Chair Brenda J. Ford relinquished her seat to Committee vice Chair Kelly Greenwell.
Sections 2-1 11 of the Hawaii County Code permits the exchange of real property for private property,
and Section 2-118, Hawaii County Code allows for the disposal of remnant parcels.
Council Member Dominic Yagong commented that due to heavy rain and flooding, Kaiwiki Road, which
is owned by the County of Hawaii, has collapsed, undermining the roadway. The road is in need of
emergency repairs. The Pang-Ching and Ojiris have agreed with the County to exchange that portion to
reconstruct the roadway for equal parcels of unused County rights-of-ways on the opposite side of their
properties. He asked for the support of his colleagues on this proposed resolution.
Your Committee on Public Works and Intergovernmental Relations is in accord with the purpose and
intent of Resolution 230-09, and recommends its adoption.
