Dear Chairman Yoshimoto and Council Members:
With due respect to the Hawaii County Council regarding the recent appointment
of Jeffrey Alexander to the North Kohala Community Development Plan (NKCDP)
Action Committee, I am removing Mr. Alexander from the committee.
The removal of Mr. Alexander is consistent with the action taken by the Hawai'i
County Council on August 19, 2009, via Communication 400, where the Council
unanimously voted to approve the nominations to the North Kohala CPD Action
Committee with the exception of Mr. Alexander.
Pursuant to Hawai'i County Code Section 16-5(e) and Hawaii County Charter
Section 13-4(b) removal requires a recommendation by the mayor and approval by the
council. I have been informed by Corporation Counsel that this letter together with the
Council's action on August 19, 2009 is legally sufficient to remove Mr. Alexander.

Committee
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Planning Committee to the full Council for immediate action. In reviewing this
matter, timely approval is crucial. It is therefore advantageous that approval be granted and the
matter be placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Planning Committee
for placement on its future agenda.
