PROVIDING FOR THE ACQUISITION OF PRIVATE PROPERTY, BEING PORTIONS OF
TAX MAP KEYS (3)7-5-017:005, 7-5-019:001, 7-5-019:038, 7-5-019:040 AND 7-5-02:001,
SITUATE AT WAIAHA 1ST, PUAPUAANUI 1ST AND KAHULUI 1 ST AND 2ND,
DISTRICT OF NORTH KONA, COUNTY AND STATE OF HAWAII, FOR THE ALIT
HIGHWAY MAUKA-MAKAI CONNECTOR ROAD.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, the volume of vehicular traffic in the North Kona area of Kailua-Kona has
greatly increased in recent years; and
WHEREAS, the lack of mauka-makai connectors between Ali'i Drive and the Queen
Kaahumanu Highway in Kailua-Kona greatly increases traffic congestion; and
WHEREAS, the County intends to build amauka-makai connector road connecting Ali'i
Drive with the Queen Kaahumanu Highway as part of its Kahului-Keauhou Parkway (Ali'i
Highway); and
WHEREAS, building amauka-makai connector road between Ali'i Drive and the Queen
Kaahumanu Highway would provide a vital link to help alleviate traffic congestion in the
Kailua-Kona area, as well as its first step in completion of its Kahului-Keauhou Parkway (Ali'i
Highway); and
WHEREAS, the County deems it necessary to invoke its condemnation powers in
acquiring portions of the above private properties to complete the mauka-makai connector road
between Ali'i Drive and the Queen Kaahumanu Highway for public use; and
WHEREAS, Section 101-13 of the Hawaii Revised Statutes requires that a condemnation
action by the County must be authorized by a resolution of the County Council.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, that it is necessary for the public use and purpose, to wit: the construction,
maintenance, operation and improvement of a mauka-makai connector road between Ali'i Drive
and the Queen Kaahumanu Highway, in the District of North Kona, County and State of Hawaii,
to take, acquire and condemn portions of those certain private properties identified as Tax Map
Keys (3)7-5-17:005, 7-5-19:001, 7-5-19:038, 7-5-19:040 and 7-5-20:001, delineated on
Exhibit "A" attached hereto.
BE IT FURTHER RESOLVED that the Corporation Counsel of the County of Hawaii be
and is hereby authorized and empowered to initiate proceedings in eminent domain, as provided
by law, for the taking, acquisition and condemnation of portions of the aforesaid private
properties.
BE IT FURTHER RESOLVED that in the process of said proceedings in eminent
domain, the Corporation Counsel be and is hereby authorized and empowered to negotiate terms
of settlement, subject to the approval of the court before which such proceedings are prosecuted.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii is directed to
transmit copies of this resolution to the following: (1) Honorable Stephen K. Yamashiro, Mayor
of the County of Hawaii; (2) the Department of Public Works; (3) the Office of the Corporation
Counsel; (4) the Gomes Family Limited Partnership, c/o Joseph Gomes, 75-397A Hualalai Road,
Kailua-Kona, Hawaii 96740; (5) David B. and Karen R. Thompson, P. O. Box 1487, Carlsbad,
California 92018; (6) Towne-Kona Ltd. Partnership, P. O. Box 893429, Mililani Hawaii 96789;
and (7) SCD Kahakai LLC, 745 Fort Street, Suite 2110, Honolulu, Hawaii 96813.
