RESOLUTION NO.
A RESOLUTION AUTHORIZING THE INITIATION OF PROCEDURES TO
CONDEMN A RIGHT-OF-WAY TO BE USED FOR A ROADWAY AS PART OF THE
KOHANAIKI SHORELINE PARK.
WHEREAS, the Kona Community Development Plan envisions a frontage road system
makai of the Queen Ka' ahumanu Highway widening project; and
WHEREAS, the Kona Community Shoreline Park at Kohanaiki anticipates access
through this frontage road; and
WHEREAS, Kohanaiki Shores Development will participate in the funding of the
construction of this road; and
WHEREAS, condemnation of the right-of-way is an issue; and
WHEREAS, timing is critical in correlating with the Queen Ka' ahumanu widening
project; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAW AI'I, that it
authorizes the initiation of procedures to condemn the right-of-way for the section of the
roadway to be used by both the Kohanaiki Community Shoreline Park and the Kohanaiki Shores
project.
BE IT FURTHER RESOLVED that the various county departments responsible for this
procedure be contacted, and their participation be solicited.

BE IT FINALLY RESOLVED that the County Clerk shall forward a coy of this
resolution to the Honorable Mayor William Kenoi, the Director of the Planning Department, the
Director of the Department of Public Works, and the Director of the State ofHawai'i Department
of Transportation.
