Pursuant to H.R.S. Section 342D-7(i), Hawaii Revised Statutes, the State Department of
Health (DOH) seeks written comments from interested persons regarding the following. Mr. Marcel
Audant, Hawaii Public Housing Authority (HPHA), 1002 North School Street, Honolulu, Oahu 96817
has applied for a variance for the maximum of five (5) years as stated in the variance application from
Hawaii Administrative Rules (HAR) Section 11-62-03 Definitions state "Individual wastewater system
means a facility which is designed to receive and dispose of no more than 1000 gallons per day of
domestic wastewater. Individual wastewater systems may involve treatment processes and include,
but are not limited to, septic tanks and household aerobic units with disposal system and cesspools.
Each individual wastewater system shall be an independent system and shall have all of its plumbing,
treatment (if any), and disposal components separate from any other wastewater systems".
Section 11-62-31.1(a)(1)(D) "General requirements for individual wastewater systems. Individual
wastewater systems may be used as a temporary on-site means of wastewater disposal in lieu of
wastewater treatment works under the following conditions: Developments involving dwellings. The
total wastewater flow into one individual wastewater system shall not exceed one thousand gallons,
and one individual wastewater system shall not serve more than five bedrooms, whether they are in
one dwelling unit or two." and Section 11-62-31.1(b)(2) "A building may use more than one individual
wastewater system where each individual wastewater system shall connect to a single dwelling unit."
Mr. Ronald Layaoen, Project Engineer, Okahara & Associates, Inc., 200 Kohola Street, Hilo, Hawaii
96750, is the individual authorized to act for the applicant. The applicant is requesting six (6) of the
proposed individual wastewater systems, serving buildings that are comprised of multiple dwellings at
16-189 Pili Mua Street, Keaau, Hawaii, 96749, TMK (3) 1-6-143: 035.
The applicant has made the following comments.
1. Five (5) of the seven (7) proposed individual wastewater systems (IWSs) would
receive more than 1000 gpd of wastewater. Four (4) of the large capacity septic
systems would receive estimated gpd flows of 1,200 gpd and one (1) IWS would
receive 1,500 gpd. The five (5) IWSs would not comply with HAR Section 11-62-03.
2. The existing large capacity cesspool(s) must be closed and replaced with a new
treatment individual wastewater system by April 5, 2005 to comply with federal
requirements.
3. The facility has been in operation for 31 years in this location using the existing
cesspool. The installation of a wastewater treatment plant is lieu of a septic system
will not be possible due to space restrictions and may force the owner to abandon
the business operation.
4. The applicant believes this variance request is in the public interest because the
LCC will be upgraded to an IWS (septic system). The IWS plans will be designed
by an engineer and will be submitted to DOH for review and approval. The new IWS
will provide a better wastewater treatment system compared to the existing LCC.
Therefore, impact to the environment will be minimized.
5. The existing LCC will be upgraded to an IWS (septic system). The IWS will provide
a better treatment system prior to effluent disposal. The IWS will be designed and
constructed to meet the Department of Health standards. The impact to the
environment will be minimized compared to the current wastewater disposal.
6. The proposed treatment individual wastewater systems will provide greater
protection than the large capacity cesspools. The proposed IWS is an improvement
to the existing cesspool in terms of wastewater treatment. The septic tank will
provide pretreatment and sludge removal prior to effluent disposal.
7. The existing location of the facility is severely restrictive. There is simply no space to
construct a wastewater treatment plant.
8. The variance is requested for the maximum of five (5) years.

II. SPECIFIC INFORMATION:
A. Describe existing facility conditions in detail, in relation to the requested variance.
(Example: Requested Variance for HAR Section 11-62-31.1 (a)(2)(C): The total area
of the subject lot is 8,500 square feet. The lot has 2 buildings on it consisting of a
restaurant and a physical therapy office which are served by a cesspool. The
estimated wastewater flow is 2, 000 gpd.)

B. Describe how the present or proposed conditions fail to conform to the environmental
rules of the State. Check applicable category and provide missing information.
[ ] The area of the lot is square feet. This is insufficient to meet
the minimum land area requirement for IWS utilization which is one IWS per
10,000 square feet of lot area.,
( ] The large capacity septic system proposed to serve the facility would not
comply with HAR Section 11-62-03 because the IWS would receive more than
1,000 gallons per day of wastewater. The estimated flow into the system
would be gallons per day.

cannot be altered to bring such facility into compliance with the environmental rules of
the State within a reasonable amount of time. Check all applicable reasons.

comply with federal requirements.
[ ] The current State requirement of a wastewater treatment plant would
significantly add to the construction and ongoing maintenance costs.

Revised Statutes, Section 342.D-6(c).
The applicant believes this variance request is in the public interest
because the LCC will be upgraded to an IWS (septic system). The
IWS plans will be designed by an engineer and will be submitted to
DOH for review and approval. The new IWS will provide a better
wastewater treatment system compared to the existing LCC.
Therefore, impact to the environment will be minimized.
[ ] Prevent loss of jobs. The LCC serving my facility has been in
operation for years. The current State requirements of a
wastewater treatment plant would significantly add to the construction
and ongoing maintenance costs. I (owner) may be forced to close my
existing business and lay off my employees.

safety.

1. Requested variance is for HAR 11-62-31.1 (a) (1) (D): The Hale Aloha O'Puna
Elderly Housing facility consists of Studio and 1 bedroom dwelling units, a
laundry facility and a Community Center contained in ten (10) separate building
structures. There are six (6) cesspools located on the property which serve the 10
buildings. The cesspools are proposed to be upgraded with the addition of seven
(7) septic tank treatment units. The estimated wastewater flows into 5 of the 7
septic tanks will each exceed 1000 gpd.
2. Requested variance is also for HAR 11-62-31.1 (b) (2): Six (6) of the proposed
Individual Wastewater Systems will each serve buildings that are comprised of
multiple dwelling units.

The Hale Aloha O'Puna Elderly Housing Facility is located in the eastern portion
of the Island of Hawai'i, in the town of Kea'au, within the Puna District. Hawai'i County
currently does not have a public wastewater system in the vicinity of the project site.
The proposed seven Individual Wastewater Systems (IWS) will be in service for
longer than the maximum 5 years under which the requested variance would be in effect
for. It is requested that a variance be issued for five (5) years with automatic renewal for
either the life of the facility or at such time that Hawai'i County installs a public
wastewater system that is reasonably accessible from the project site.

Studio Dwelling Unit, 6 Dwelling units: No. of Bedrooms = 6 Bdrms.
6 Bdrms. @ 200 gal/bdrm = 1,200 gpd
TOTAL (Design Flow): 1,200 gpd
2) SEPTIC SYSTEM
a) SEPTIC TANK
Minimum Liquid Volume : = 1,000 + (Q - 800) (1.25)
= 1,000 + (1,200 - 800) (1.25)
1,500 gpd
It is proposed to use one (1) 2,000 gallon, two compartment septic tank.
(A tank with a greater capacity is proposed to address the additional
scum and sludge accummulation from the 6 dwelling units)
Tank Selected:
Manufacturer: Xerxes or a Septic Tank Approved and Listed
by IAPMO with capacity equal to or greater than
2000 gallons.
b) EFFLUENT DISPOSAL
The proposed method of effluent disposal shall be an Absorption Bed.
Percolation Rate : 1 min/in 70 sf required per 200 gpd
Required Absorption Area : = (1200 gpd) x (70 sf / 200 gpd)
= 420 sf
Absorption Bed: 24' x 18' (432 sf provided) over 3' (min.) of
cinder or suitable soil replacement material.

TOTAL (Design Flow): 1,200 gpd
2) SEPTIC SYSTEM
a) SEPTIC TANK
Minimum Liquid Volume : = 1,000 + (Q - 800) (1.25)
= 1,000 + (1,200 - 800) (1.25)
= 1,500 gpd

Tank shall be capable of withstanding an H-20 wheel load as defined by
the American Association of State Highway Officials.
Tank Selected:
Manufacturer: Jensen Precast or a Septic Tank Approved and Listed
by IAPMO with capacity equal to or greater than
2000 gallons, suitable for H-20 traffic loading.
b) EFFLUENT DISPOSAL
The proposed method of effluent disposal shall be a Seepage Pit.
The existing cesspool serving the six dwelling units will be converted
for use as a seepage pit.
