SUBJECT: TRAFFIC CODE AMENDMENT:
MAHI'AI ROAD NORTHEAST APPROACH AT THE AMAUMAU ROAD
INTERSECTION IN PUNA
We request the Hawai'i County Code, Chapter 24, Article 10, Division 2. Moving Vehicles,
Section 24-264, Schedule 12. Stop intersections, paragraph (g) Puna be amended by deleting
item (16).
We request the Hawai'i County Code, Chapter 24, Article 10, Division 2. Moving Vehicles,
Section 24-265, Schedule 13. Yield locations, paragraph (g) Puna be amended by adding new
item:
H MAHI'Al ROAD, NORTHEAST APPROACH AT THE AMAUMAU ROAD
INTERSECTION.
In an effort to address a request from the public to clarify who has the right of way at the
subject intersection, we propose to remove the stop control at the southeast approach of
Amaumau Road and revise the stop control to a yield control at the northeast approach of
Mahiai Road.
We feel this change gives right of way to the higher volume route (northeast leg of
Mahi'ai Road - Amaumau Road) and yield control to the lower volume route
(northeast Mahi'ai Road approach to the Amaumau Road intersection). In this case, it is
our opinion that addressing the right of way based on volume will lead to greater respect
by the motorists. A location map is attached for your reference.

SUBJECT: TRAFFIC CODE AMENDMENT - MAHI'AI ROAD
Waive Committee Request
I am in the process of making two amendments to the schedules section of the Hawaii County
Code. The changes to be made include removing an existing stop control on Amaumau Road
and adding a new yield control on Mahi'ai Road.
On May 19, 2009, Director of Public Works, Warren H. W. Lee exercised his temporary
authority, pursuant to Section 24-11 of the Hawaii County Code allowing for the field work to be
completed while the code amendment process is taking place. The temporary authority lasts for
180 calendar days.
The field work related to the aforementioned code amendments includes removing inapplicable
traffic signs and installing new traffic signs and striping. The striping work was completed as a
part of the Wright Road/Mahi'ai Road resurfacing/restriping project handled by our price term
contractor and the sign work was handled by the Traffic Division at the same time. The work
was completed at the ending of May 2009.
In order to ensure that the code amendment process is completed within the 180-day temporary
authority period, I would like to request that the pertinent amendments be waived from

A written memo dated September 17, 2009 from Traffic Division Chief request two amendments
to the schedules section of the Hawaii County Code be waived from the Committee on Public
Works and Intergovernmental Relations. Pursuant to Section 2(g) of Rule 4 of the Rules of
Procedure of the Council of the County of Hawaii, this written request is submitted with my
approval that the above-referenced matter be waived from the Committee on Public Works and
Intergovernmental Relations to the full Council for immediate action. In reviewing this matter,
timely approval is crucial. It is therefore advantageous that approval is granted and the matter
placed onto the next Council agenda for review. However, in the event this request is denied, for
whatever reason, I understand the matter shall be referred to the Committee on Public Works and
Intergovernmental Relations for placement on its future agenda.
