ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 24 OF THE HAW AI'I COUNTY CODE 1983
(2005 EDITION, AS AMENDED), RELATING TO VEHICLES AND TRAFFIC.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAW AI'I:
SECTION 1. Purpose. The purpose of this amendment is to alter the right of way at the
subject intersection based on the route having higher traffic volume. Accordingly, this
amendment would remove the stop control at the southeast approach of Amaumau Road and add
a yield control at the northeast approach of Mahi' ai Road.
SECTION 2. Chapter 24, article 10, division 2, section 24-264 (Schedule 12. Stop
intersections), paragraph (g), Puna, of the Hawai'i County Code 1983 (2005 Edition, as
amended), is amended to delete paragraph (16) as follows:
"(16) Entering Mahi'ai Road intersection from ,^..maumau Road from a
southwesterly direction."
SECTION 3. Chapter 24, article 10, division 2, section 24-265 (schedule 13. Yield
locations), paragraph (g), Puna, of the Hawai'i County Code 1983 (2005 Edition, as amended), is
amended by adding the following, to be appropriately numbered and to read as follows:
"() Mahi' ai Road. northeast approach at the Amaumau Road
intersection. "
SECTION 4. Material to be repealed is bracketed and stricken. New material is
underscored. In printing this ordinance, the brackets, bracketed material and stricken material
and underscoring need not be included.
SECTION 5. If any provision of this ordinance, or the application lhereofto any person
or circumstance, is held invalid, such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid provision or application, and to
this end, the provisions of this ordinance are declared to be severable.
SECTION 6. This ordinance shall take effect upon its approval.
