HomeMy WebLinkAboutRES 243 Draft 01 2008-2010 COUNTY OF HAWAI'I STATE OF HAWAI'I RESOLUTION NO. 243 09 A RESOLUTION AUTHORIZING THE EXTENSION OF THE PUBLIC SEWER FROM THE UH HILO ENTRANCE AT PARCEL 2-4-056:017 TO THE INTERSECTION OF LEILANI/MANONO STREET FOR THE STATE OF HA W AI'I, UNIVERSITY OF HAWAI'I AT HILO, HAWAI'I. WHEREAS, applicant State of Hawai'i, University of Hawai'i at Hilo has requested to extend the sewer in accordance with section 21-26, Hawai'i County Code to service the upper portion of the UH Hilo campus including parcels; 2-4-001:007, 2-4-001:041, 2-4-001:122, 2-4- 001 :169, and 2-4-056:017. Also, the parcels; 2-4-056:001 and 2-4-056:003 will be made accessible to this extension; and WHEREAS, the proposed sewer extension is actually a parallel sewer line on Lanikaula Street that will handle wastewater generated from existing improvements and future construction on parcels 2-4-001 :007,2-4-001 :041,2-4-001 :122,2-4-001 :169, and 2-4-056:017. A typical sewer lateral connection is not feasible due to inadequate sewer capacity on Lanikaula Street's existing Public Sewer. Therefore, a proposed parallel sewer extension on Lanikaula Street is required to handle the future wastewater generated from said parcels; and WHEREAS, applicant State of Hawai'i, University of Hawai'i at Hilo, will bear the total cost of the construction and will be eligible to exercise conditions under Section 21-28(a), Hawai'i County Code pertaining to receipt for 10 years after completion of the extension one- half of all moneys for sewer charges collected by the County from other properties, if any, connecting to the extension provided the total of such reimbursement shall not exceed the cost incurred by the applicant to construct the extension and WHEREAS, the Director of Environmental Management has recommended approval of the extension according to section 21-27, Hawai'i County Code; and Attachment "A" is an application from the State of Hawai'i, University of Hawai'i at Hilo, with a vicinty map as supporting documentation; and WHEREAS, sewer extensions are beneficial to the community by eliminating the need of alternative waste treatment options and reducing the amount of pollutants reaching the groundwater and the coastal waters, resulting in a cleaner, healthier environment; and WHEREAS, section 21-26, Hawai'i County Code, requires that the council approve all sewer extensions; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HA W AI'I that the sewer extension to Leilani/Manono Street Intersection for the State of Hawai'i, University of Hawai'i at Hilo is hereby approved. BE IT FURTHER RESOLVED that the request of the applicant to be reimbursed for the cost of the sewer extension in accordance with Section 21-28(a) is hereby approved. BE IT FURTHER RESOLVED that the Clerk of the County of Hawai'i transmits . copies of this resolution to the Departments of Finance, Public Works and Environmental Management.
