HomeMy WebLinkAboutRES 245 Draft 01 1998-2000 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 245 00 RESOLUTION AUTHORIZING THE ACCEPTANCE OF LAND FROM BP PARTNERS, A HAWAII GENERAL PARTNERSHIP AND PAN-PACIFIC DEVELOPMENT, INC., A HAWAII CORPORATION, TAX MAP KEY (3) 6-5-003- 004, FOR THE WAIMEA TRAILS & GREENWAYS PROJECT, WAIMEA, DISTRICT OF SOUTH KOHALA WHEREAS, the County of Hawaii has been creating an alternative transportation comdor at Waimea, District of South Kohala, known as the Waimea Trails &Greenways Project; and WHEREAS, BP PARTNERS, a Hawaii General Partnership, and PAN-PACIFIC DEVELOPMENT, INC., a Hawaii Corporation, ("Owner") are the owners of that parcel of real property bearing Tax Map Key No. (3) 6-5-003-004; and WHEREAS, said real property is part of the Waimea Trails &Greenways corridor; and WHEREAS, Owner wishes to donate said real property to the County of Hawaii to be used as a part of said Waimea Trails &Greenways corridor; and WHEREAS, Article XIII, Section 13-12, of the Hawaii County Charter provides that the Council, on behalf of the County, may accept gifts or donations of real property. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that in accordance with Article XIII, Section 13-12, of the Hawaii County Charter, the County of Hawaii is authorized to accept the donation of the real property containing an area of 1.238 acres, more or less, Tax Map Key (3) 6-5-003-004 from Owner BP PARTNERS and PAN-PACIFIC DEVELOPMENT, INC. BE IT FURTHER RESOLVED that a letter of appreciation be sent to BP PARTNERS at 1099 Alakea Street, Suite 1170, Honolulu, HI 96813, and PAN-PACIFIC DEVELOPMENT, INC., at 2621 Waiwai Loop, Honolulu, HI 96819, acknowledging this generous donation. BE IT FURTHER RESOLVED that the Department of Pazks and Recreation is hereby authorized to consolidate and resubdivide the pazcel with adjoining pazcels for purposes of optimally locating the trail, provided that the consolidation and resubdivision does not result in a substantial net loss of acreage to the County of Hawaii. BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) Owner BP PARTNERS and PAN-PACIFIC DEVELOPMENT, INC; (2) Department of Finance; (3) Department of Public Works; and (4) Gerald Takase, Deputy Corporation Counsel, who will record the Deed.
