The amount of land, 10 acres, to trigger or red flag properties to have special scrutiny and later to be auctioned or to be sold by the County is not sufficient. It should be AMMENDED to say "any parcel of land" 2. We are not dealing with typical "Real Estate" here in Hawaii. Any regular title research may not be enough to protect the Hawaiian interests from theft or from continued acts of the overthrow. Some of the paperwork may reveal certain criminal acts that must not be perpetuated through clouded title. The County Council has a duty to the people to not engage the budget and public service with proceeding in criminal acts of land theft. 3. EXAMPLE: Documents submitted by the Title Guarantee is an example of evidence of overthrow and the following of Public Law 103-150...known as the Apology Bill. This bill concerns any land, and doesn't mention Hamakua lands specifically, the Title Research of the Hamakua Lands up for auction to Balance the Budget revealed land taken directly after the Overthrow, on the Royal Patents in Pauilo, her name and heirs & successors were crossed out, Queen was crossed out, and other names and dates all put in by the My point is, that according to the Apology Bill, the land was stolen, these Patent titles are clear evidence, coming through the County Council who has taken an oath and must uphold the laws of the United States. The Republic of Hawaii, the Overthrow they were Stealing her Royal Estate while they have her in prison; transferring the title illegally. Do the County Council members feel that perpetuating false title is just or think the auction of Patented stolen land is a legal sale, knowing the Apology Bill is a Law to be upheld. Real Estate Lawyers stated that a title with the name scratched out and someone else's name drawn over it is a criminal act and is broken title. Consumer Protection stated they agreed it is also an E & 0 Errors and Omissions. Illegal sale of property that does not belong to the party who claims they have a right to sell it. 4. The Resolution must state some sort of plan, it must include the proper methods for the care of the property and if the title stated to be in the County of Hawaii's possession is found to be actually stolen property as a result of the overthrow, then in accordance with PL 103-150 the County of Hawaii will in-act certain measures to return the land to the rightful owner. The Resolution should clearly state how this stolen property will be returned to it's rightful owner: SUGGESTIONS: a. Mahele Title search/Files b. Land Placed in Trust, notify proper cultural practitioners of TCP/Sect. 106 Consultation c. Lineal Heirs and Collateral Heirs contacted by newspaper Legal Ads and OHA Wai Ola d. Notice to Ohana concerning type of Mahele Award or Patent e. Notice to Ohana Concerning Undivided Interest, dismiss retroactive taxes to Kuleana, etc f. Verbal notice to the County Council not to sell lands associated with the overthrow. 10. Operations of the County Council must adhere to the laws, including Public Law 103-150 concerning the stolen lands of Hawaii. The resolution must take this into all effects of this resolution.
