ORDINANCE NO. 09 122
AN ORDINANCE AMENDING CHAPTER 24 OF THE HAWAII COUNTY CODE 1983
(2005 EDITION, AS AMENDED), RELATING TO VEHICLES AND TRAFFIC.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. The purpose of this amendment is to create an active loading and
unloading zone for freight and passengers adjacent to the Palace Theater.
SECTION 2. Chapter 24, article 10, division 5, section 24-284 (schedule 32. Two hour
parking areas), paragraph (c), South Hilo, of the Hawaii County Code 1983 (2005 Edition, as
amended), is amended by revising subparagraph (6) to read as follows:
"(6) Haili Street between Kamehameha Avenue and Kino`ole Street[.],
except for active loading and unloading zone, northwest side,
beginning from a point two hundred eleven feet southwest of
Kamehameha Avenue and extending twenty feet in the
southwesterly direction, as set forth in section 24-288.1 (schedule
36.1. Active loading and unloading zones)."
SECTION 3. Chapter 24, article 10, division 6, section 24-288.1 (schedule 36.1. Active
loading and unloading zones), paragraph (c), South Hilo, of the Hawaii County Code 1983
(2005 Edition, as amended), is amended by adding the following subparagraph, to be
appropriately numbered and to read as follows:
) Haili Street, northwest side, beginning from a point two hundred
eleven feet southwest of Kamehameha Avenue and extending
twenty feet in the southwesterly direction."
SECTION 4. Material to be repealed is bracketed and stricken. New material is
underscored. In printing this ordinance, the brackets, bracketed material and stricken material
and underscoring need not be included.
SECTION 5. If any provision of this ordinance, or the application thereof to any person
or circumstance, is held invalid, such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid provision or application, and to
this end, the provisions of this ordinance are declared to be severable.
SECTION 6. This ordinance shall take effect upon its approval.
