RESOLUTION NO. 259 00
RESOLUTION AUTHORIZING THE ACCEPTANCE OF LAND FROM HENRY B.
CLARK, JR., TAX MAP KEY (3) 6-2-007-001, FOR THE WAIMEA TRAILS &
GREENWAYS PROJECT, WAIMEA, DISTRICT OF SOUTH KOHALA
WHEREAS, the County of Hawaii has been creating an alternative transportation comdor at Waimea,
District of South Kohala, known as the Waimea Trails &Greenways Project; and
WHEREAS, HENRY B. CLARK, JR., ("Owner") is the owner of that parcel of real property bearing
Tax Map Key No. (3) 6-2-007-001; and
WHEREAS, said real property is part of the Waimea Trails &Greenways comdor; and
WHEREAS, Owner wishes to donate said real property to the County of Hawaii to be used as a part of
said Waimea Trails &Greenways corridor and not to be used or sold for any purpose other than a park (except
as necessary For road widening or other essential public purposes); and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter provides that the Council, on
behalf of the County, may accept gifts or donations of real property.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII
that in accordance with Article XIII, Section 13-12, of the Hawaii County Charter, the County of Hawaii is
authorized to accept the donation of the real property known as Lot 1, Kamuela Plantation, Unit 1, File Plan
1716 filed in the Bureau of Conveyances, State of Hawaii (8.00 acres, more or less) from owner to be used as a
park.
BE IT FURTHER RESOLVED that a letter of appreciation be sent to HENRY B. CLARK, JR., 3003
Kalakaua Avenue, Suite 12A, Honolulu, HI 96815, acknowledging this generous donation.
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (I) Owner HENRY B.
CLARK, JR.; (2) Department of Finance; (3) Department of Public Works; and (4) Gerald Takase, Deputy
Corporation Counsel, who will record the Deed.
