COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 26~ Draft 2 RESOLUTION ADOPTING THE ISLAND OF HAWAII SELF-EVALUATION AND TRANSITION PLAN FOR ACCESSIBILITY TO PUBLIC FACILITIES BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII: WHEREAS, 28 C.F.R. §§35.105 AND 35.150 call for the County of Hawaii to perform aSelf-Evaluation of its current services, policies, and practices that do not, or may not, meet the requirements of 28 C.F.R., Part 35, and to prepare a Transition Plan setting forth the steps necessary to complete or augment changes to achieve program accessibility; and WHEREAS, the Settlement Agreement Release and Order filed in Alexa Russell and John Hartman, et al. vs. County of Hawaii, USDC Civil No. 97-01102SPK on June 4, 1998, requires that by June 4, 2000 the County of Hawaii adopt aSelf-Evaluation and Transition Plan of the accessibility of all of the facilities under the jurisdiction of the Parks and Recreation Department; and WHEREAS, the County of Hawaii expanded the scope of the Self-Evaluation and Transition Plan to include all public facilities under its jurisdiction; WHEREAS, the County of Hawaii through its consultant Beimborn/Kekoa Associates Architects has completed the Self-Evaluation and Transition Plan for Accessibility to Public Facilities, a copy of which is attached hereto as Exhibits "A," "B," and "C." NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Self-Evaluation and Transition Plan for Accessibility to Public Facilities is hereby adopted. BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii provide a copy of this Resolution to the Mayor, the Director of the Parks and Recreation Department, the Chief of Police, the Fire Chief, the Chief Engineer, Corporation Counsel and the ADA Coordinator of the County of Hawaii.
