RESOLUTION NO. 253 09
RESOLUTION ACCEPTING THE DONATION OF LOT 4-13 AND EASEMENT "A," SITUATE
AT HONOKOHAU 2ND, DISTRICT OF NORTH KONA, COUNTY AND STATE OF HAWAII,
IDENTIFIED AS TAX MAP KEY: (3)7-4-006:037 (PORTION), FROM CHURCH OF CHRIST,
KONA, HAWAII, INCORPORATED.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, Church of Christ, Kona, Hawaii, Incorporated ("Church of Christ"), is the owner
of Lot 4-13, containing an area of 3,713 square feet, and Easement "A," containing an area of
200 square feet, situate at Honok6hau 2nd, in the District of North Kona, County and State of Hawaii,
identified as Tax Map Key: (3)7-4-006:037 (portion), and delineated on Exhibit "I" attached hereto;
and
WHEREAS, as part of the Palani Road improvements, the County of Hawaii added a left turn
lane and drainage easement, which required the acquisition of land from the Church of Christ; and
WHEREAS, the Church of Christ is desirous of donating the subject parcel and drainage
easement to the County of Hawaii; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the
Council may accept gifts, which include the donation of land on behalf of the County of Hawaii.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, the
County of Hawaii accepts the donation of Lot 4-13, containing an area of 3,713 square feet, and
Easement "A," containing an area of 200 square feet, situate at Honokohau 2nd, in the District of
North Kona, County and State of Hawaii, identified as Tax Map Key: (3)7-4-006:037 (portion), and
delineated on Exhibit "1" attached hereto.
BE IT FURTHER RESOLVED that a letter of appreciation be sent to Philip R. Stroud,
Minister, Kona Church of Christ, 74-4907 Palani Road, Kailua-Kona, Hawaii 96740.
BE IT AL'5(i5~LVED that a copy of this resolution be forwarded to:
(1) Mayor William P. Kenoi; (2) Director of Public Works Warren H.W. Lee; (3) Deputy Corporation
Counsel Gerald Takase; and (5) Philip R. Stroud, Minister, Kona Church of Christ, 74-4907 Palani
Road, Kailua-Kona, Hawai'i 96740.
