HomeMy WebLinkAboutRES 270 Draft 01 1998-2000 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 2'70 00 A RESOLUTION RELATING TO A COUNCIL INITIATED IMPROVEMENT DISTRICT TO FACILITATE CONSTRUCTION OF PERMANENT IMPROVEMENTS TO THE KONA COASTVIEW AND KONA WONDERVIEW SUBDIVISIONS IN NORTH KONA, COUNTY OF HAWAII, INCLUDING THE IMPROVEMENT OF THE WATER DISTRIBUTION SYSTEM TO THE COUNTY OF HAWAII DEPARTMENT OF WATER SUPPLY STANDARDS, IN ACCORDANCE WITH THE HAWAII COUNTY CODE RELATING TO IMPROVEMENTS BY ASSESSMENTS. WHEREAS, the Council of the County of Hawaii is aware that privately operated water distribution systems for the Kona Coastview and Kona Wonderview Subdivisions, located in North Kona, County of Hawaii, are not built to County standards; and WHEREAS, the Hawaii County Council eazlier adopted Resolution No. 149-93 on January 26, 1994 directing the chief engineer to prepare and submit a report to the Council, and further adopted Resolution No. 352-96 on September 6, 1996 relating to a Council initiated water improvement district for the Kona Coastview and Kona Wonderview Subdivisions; and WHEREAS, at a noticed public hearing held on November 1, 1996 on the water system improvement district proposed in Resolution No. 352-96 various objections were heard to the project and the estimated cost to be borne by assessees and, therefore, no subsequent Improvement District ordinance was adopted by the County Council; and WHEREAS, residences in the aforementioned subdivisions receive water from a substandazd and antiquated private water service fed by above-ground plastic pipes known as "spaghetti lines"; and WHEREAS, the privately operated water service has a history of breakdowns, leakage, and is considered at risk for total system failure due to a lack of operating and maintenance funds by the private operator; and WHEREAS, firefighters could not get enough water from the Kona Coastview subdivision water system to douse flames that destroyed a residence in the Coastview subdivision and, therefore, were assisted with water supply and manpower provided by firefighters from Hawaiian Pazadise Park, Keaau and Hawaiian Beaches in February, 1999, as reported by West Hawaii Today; and WHEREAS, in its letter dated September 7, 1999 the Rural Development office of the U.S. Department of Agriculture indicated that the County of Hawaii could be an eligible applicant for the Rural Utilities Water and Waste Disposal Loan and Grant Program for the proposed water system installation project for the Kona Coastview and Wonderview Subdivisions and further indicated that the County's Improvement District Bond is acceptable to USDA/Rural Development for security on the loan portion of the program; and WHEREAS, at a community meeting held on October 20, 1999 at the Old Airport Pavilion in Kona, an overwhelming majority of residents and homeowners voiced support for renewed efforts to initiate a water systems improvement district ordinance in conjunction with joint funding from the U.S. Department of Agriculture Rural Utilities Water and Waste Disposal Loan and Grant Program; and WHEREAS, the first requirement for creating a special improvement district is for this Council to direct the Chief Engineer to investigate and report on the proposed project, and WHEREAS, it is therefore prudent to require that the report for the subject improvement district forwarded by Department of Water Supply Manager Milton D. Pavao, P.E. dated May 29, 1996 be updated to assure that improvement district boundaries, proposed water system improvement requirements, projected costs, and proposed assessments are thoroughly compiled and accurate for subsequent review and evaluation by the County Council and affected homeowners in the proposed improvement district. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Manager, Department of Water Supply, is hereby directed to prepaze and submit to the Council an update of a report titled Water System Installation Cost Estimate For Improvement District -Kona Coastview and Kona Wonderview Subdivisions (May, 1996), to contain the following: (1) A review of findings and data assembled in the 1996 report concerning the special improvement district to be constructed, to include any revisions based on recent findings and analysis; (2) The general character and extent of any improvement to be proposed; (3) The proposed method of assessment whether on a frontage, azea, or other basis; (4) Whether any new land will be deemed necessary to be acquired, and the estimated cost thereof, and the proportion of the cost which should be borne by the County of Hawaii; (5) The materials recommended to meet the conditions of improvement; (6) The boundaries of the proposed improvement district and any subdistricts and zones therein as to which different portions of the costs of improvements should be chazged; (7) The estimated cost of the improvement, and the portions of the costs to be assessed against the lands specially benefited with the maximum unit of assessment to be made against each lot to be assessed; and (8) All necessary plans and other data, details, and specifications for the improvements and any other matters or details intended to apply thereto. BE IT FURTHER RESOLVED that the County Clerk is hereby directed to furnish copies of this resolution to Mayor Stephen K. Yamashiro; Department of Water Supply Manager Milton D. Pavao, P.E.; Chief Engineer Robert Yanabu; Water Commission Chairman John Clark; and Steven R. Chapman, Acting State Director, Rural Development, Hawaii State Office, U.S. Department of Agriculture.
