RESOLUTION NO.271 00
PROVIDING FOR THE ACQUISITION OF PRNATE PROPERTY, BEING A PORTION OF
TAX MAP KEY (3)2-2-027-044, SITUATE AT WAIAKEA, DISTRICT OF SOUTH HILO,
COUNTY AND STATE OF HAWAII, FOR IMPROVEMENTS AT THE INTERSECTION
OF LANIKAULA AND MANONO STREETS.
BE TT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, the County is planning to improve the intersection of Lanikaula and Manono
Streets by installing traffic signals, widening the road and constructing sidewalks to address
automobile/pedestrian safety and traffic volume concerns; and
WHEREAS, additional rights-of-way are required for these improvements; and
WHEREAS, the County has been able to voluntarily acquire additional rights-of way from
various owners, except the above parcel, requiring that the County invoke its condemnation
powers in acquiring a portion of the above private property to complete the improvements at the
intersection of Lanikaula and Manono Streets; and
WHEREAS, Section 101-13 of the Hawaii Revised Statutes requires that a condemnation
action by the County must be authorized by a resolution of the County Council.
NOW, THEREFORE, BE TT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, that it is necessary for the public use and purpose, to wit: improve the intersection of
Lanikaula and Manono Streets by installing traffic signals, widening the road and constructing
sidewalks, to take, acquire and condemn a portion of that certain private property identified as
Tax Map Key No. (3)2-2-27-044, described in Exhibit "A" and delineated on Exhibit "B"
attached hereto.
BE IT FURTHER RESOLVED that the Corporation Counsel of the County of Hawaii be
and is hereby authorized and empowered to initiate proceedings in eminent domain, as provided
by law, for the taking, acquisition and condemnation of a portion of the aforesaid private
property.

BE Tf FURTHER RESOLVED that in the process of said proceedings in eminent
domain, the Corporation Counsel be and is hereby authorized and empowered to negotiate terms
of settlement, subject to the approval of the court before which such proceedings are prosecuted.
BE TI' FURTHER RESOLVED that the Clerk of the County of Hawaii is directed to
transmit copies of this resolution to (1) the Honorable Stephen K. Yamashiro, Mayor of the
County of Hawaii; (2) the Department of Public Works; (3) the Office of the Corporation
Counsel; and (4) William J. N. Garcia, P. O. Box 128, Kamuela, Hawaii 96743, attorney for the
property owners.
