RESOLUTION AUTHORIZING THE MAYOR OF THE COUNTY OF HAWAII OR, IN HIS
ABSENCE, THE MANAGING DIRECTOR OR AUTHORIZED REPRESENTATIVE TO ACQUIRE A
HOME IN WAIMEA, SOUTH KOHALA, HAWAII (TMK: 6-4-19:54) FROM THE UNITED
STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT UNDER THE $1 HOME
SALES TO LOCAL GOVERNMENTS PROGRAM.
WHEREAS, the primary objective of the Office of Housing and
Community Development is for the development of viable communities by
providing decent housing, suitable living environments and expanding
economic opportunities, principally for persons of low and moderate
income; and
WHEREAS, the County's Consolidated Plan considers the development
of affordable and special needs housing a high priority; and
WHEREAS, the United States Department of Housing and Urban
Development (HUD), has implemented the home sales to local governments
program, which allows local governments to purchase properties that have
been listed for sale for more than six months for a dollar ($1.00); and
WHEREAS, the County may wish to take advantage HUD's homes for a
dollar program from time to time; and
WHEREAS, the Office of Housing and Community Development shall
seek the approval of the County Council prior to the disposition of each
unit acquired, pursuant to the $1 Home Sales to Local Governments
Program; and
WHEREAS, HUD requires that the transaction to purchase the homes
close within sixty (60) days; and
WHEREAS, a timely submission of this Resolution is required in
order to close this and all future acquisitions within sixty (60) days
from the date the Sales Contracts are signed by the Mayor, in accordance
with appropriate federal regulations, is necessary; and
WHEREAS, HUD has made a home available under this program to the
County located in Waimea, South Kohala, Hawaii (TMK: 6-4-19:54).
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, the Mayor of the County of Hawaii or, in his absence, the
Managing Director is hereby designated to act as the representative of
the County and is hereby authorized to execute the sales agreement and
all other related documents and agreements necessary to expedite and
process the purchase of the home identified as TMK: 6-4-19:54, pursuant
to the $I Home Sale to Local Governments from the United States
Department of Housing and Urban Development program.
BE IT FURTHER RESOLVED that the Office of Housing and Community
Development shall first evaluate homes offered to the County for any
hazardous materials (such as asbestos, lead-based paints) and other
public health hazards; evaluate the appropriateness and costs of
renovations to the units; make its recommendation to the mayor; and
inform the Housing Agency of its recommendation.
BE IT FURTHER RESOLVED, that the County shall utilize the acquired
property in accordance with program rules and regulations and comply
with the $1 Home Sales to Local Governments Program.
BE IT FURTHER RESOLVED, that the Office of Housing and Community
Development shall seek approval from the Hawaii County Council prior to
the disposition of any property acquired pursuant to the $I home sales
to local governments program.
BE IT FURTHER RESOLVED, that a copy of this resolution be
transmitted to the Office of Housing and Community Development.
