RESOLUTION N0.286
PROVIDING FOR THE ACQUISITION OF PRIVATE PROPERTY AND EASEMENTS,
BEING PORTIONS OF TAX MAP KEY (3)2-5-061:036, SITUATE AT KUKUAU 2ND,
DISTRICT OF SOUTH HILO, COUNTY AND STATE OF HAWAII, FOR THE PUAINAKO
STREET EXTENSION.
BE iT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
WHEREAS, the County of Hawaii has planned and is ready to extend the existing
Puainako Street in lower Hilo to the Saddle Road junction with Kaumana Drive in upper Hilo;
and
WHEREAS, this road extension will help alleviate vehicular traffic congestion on the
existing Kaumana Drive that has historically suffered from a high ratio of traffic accidents; and
WHEREAS, this road extension will also provide a safe highway standard connection to
the planned Saddle Road improvement project connecting East and West Hawaii; and
WHEREAS, the extension of Puainako Street would entail the acquiring by the County of
a portion of and easements across Tax Map Key (3)2-5-061:036; and
WHEREAS, the extension of Puainako Street has been determined by the County of
Hawaii as providing a regional public use and purpose which will benefit the County of Hawaii;
and
WHEREAS, the County deems it necessary to invoke its condemnation powers in
acquiring a portion of and easements across the above private property to complete the extension
of Puainako Street; and
WHEREAS, Section 101-13 of the Hawaii Revised Statutes requires that a
condemnation action by the County must be authorized by a resolution of the County Council.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, that it is necessary for the public use and purpose, to wit: the extension of Puainako
Street in lower Hilo to the Saddle Road junction with Kaumana Drive, in the District of South
Hilo, County and State of Hawaii, to take, acquire and condemn a portion of and easements
across that certain private property identified as Tax Map Key (3)2-5-061:036, described in
Exhibit "A" attached hereto.
BE IT FURTHER RESOLVED that the Corporation Counsel of the County of Hawaii
be and is hereby authorized and empowered to initiate proceedings in eminent domain, as
provided by law, for the taking, acquisition and condemnation of a portion of and easements
across the aforesaid private property.
BE IT FURTHER RESOLVED that in the process of said proceedings in eminent
domain, the Corporation Counsel be and is hereby authorized and empowered to negotiate terms
of settlement, subject to the approval of the court before which such proceedings are prosecuted.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii is directed to
transmit copies of this resolution to the Honorable Stephen K. Yamashiro, Mayor of the County
of Hawaii, the Department of Public Works, the Office of the Corporation Counsel, and
Brilhante-Hawaii, Inc., owner of the subject property.
