Home My WebLink AboutRES 260 Draft 01 2008-2010 COUNTY OF HAW AI'I ST ATE OF HAW AI'I RESOLUTION NO. 260 09 RESOLUTION ACCEPTING THE DEDICATION OF ROAD LOTS "A" (KUMAKUA STREET), "B" AND "D" (POMAIKA'I STREET), AND "c" (PUPUKAHI STREET), OF KUMAKUA AFFORDABLE HOUSING SUBDIVISION, PHASE 1, BEING TAX MAP KEY: (3) 5-5-019:026, SITUATE AT pAHGA, DISTRICT OF NORTH KOHALA, COUNTY AND STATE OF HAWAI'I, FROM HAW AI'I ISLAND COMMUNITY DEVELOPMENT CORPORATION. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAW AI'I. WHEREAS, Hawai'i Island Community Development Corporation is the owner of: Road Lot "A" Road Lot "B" Road Lot "c" Road Lot "D" Kiimakua Street Pomaika'i Street Piipiikahi Place Pomaika'i Street 0.13 mile 0.04 mile 0.03 mile 0.03 mile identified as Tax Map Key: (3) 5-5-019:026, situate at Pahoa, in the District of North Kohala, County and State ofHawai'i, as delineated on Exhibit "A" attached hereto; and WHEREAS, Hawai'i Island Community Development Corporation has constructed all subdivision improvements and received final subdivision approval; and WHEREAS, Hawai'i Island Community Development Corporation is desirous of dedicating the above roadway lots, including all subdivision improvements thereon, to the County of Hawai' i for road and drainage purposes, and the improvements have been inspected and approved by the County of Hawai'i Department of Public Works, and received dedication approval from the Department of Water Supply, Planning Department and Department of Environmental Management; and WHEREAS, the subject roads and drainage improvements have been completed according to County of Hawaii standards, and are in acceptable condition for dedication, and in full compliance with the provisions of Chapter 23 of the Hawaii County Code; and WHEREAS, Section 23-10 of the Hawaii County Code prohibits the Council from receiving by dedication any streets in any subdivision platted after December 2, 1966 except upon full compliance with the provisions of Chapter 23; and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the council may accept gifts, which include the dedication of land, on behalf of the County of Hawaii. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds the subject subdivision and improvements thereon are in full compliance with the provisions of Chapter 23 of the Hawaii County Code as certified and approved by all applicable agencies. BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, and Section 23-10 of the Hawaii County Code, that the County of Hawaii accepts the dedication of: Road Lot "A" Kumakua Street 0.13 mile Road Lot "B" P6maika`i Street 0.04 mile Road Lot "C" Pupukahi Place 0.03 mile Road Lot "D" P6maika`i Street 0.03 mile identified as Tax Map Key: (3) 5-5-019-026, delineated on Exhibit "A" attached hereto, including all improvements thereon, for public road and drainage purposes. BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) Mayor William P. Kenoi; (2) the Department of Public Works; (3) Deputy Corporation Counsel Gerald Takase; and (4) Brian T.
