RESOLUTION NO. 266 09
RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO
DISPOSE OF REAL PROPERTIES, TAX MAP KEYS (3)5-4-002-008
(TANK SITE) AND (3)5-4-003-016 (CHLORINATOR SITE), TO THE
WATER BOARD OF THE COUNTY OF HAW AI'I.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAW AI'I:
WHEREAS, the County ofHawai'i obtained a tank sIte (Tax Map Key (3)5-4-002-008)
("tank site"), as shown on Exhibit A attached hereto, and a chlorinator site (Tax Map

Key (3 )5-4-003-0 16 ("chlorinator site"), as shown on Exhibit B attached hereto, located in
Hanaula, North Kohala, County and State of Hawai 'i, from Kohala Sugar Company in 1961; and
WHEREAS, the Department of Water Supply maintains the chlorinator site and tank site;
and
WHEREAS, the Water Board of the County ofHawai'i now owns the reservoir located
on Tax Map Key (3)5-4-002-022 ("reservoir site"), which is adjacent to the tank site, as shown
on Exhibit C attached hereto; and
WHEREAS, the Water Board of the County ofHawai'i desires to expand its existing
reservoir site and other water system facilitIes at this location, and plans to consolidate the tank
site with its newly acqUIred reservoir site; and
WHEREAS, Section 2-120, Hawai'i County Code, authorizes the disposal of real
property of the County, under such terms and conditIOns of sale that council deems proper, to the
Water Board of the County ofHawm'i as a governmental agency.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAW AI'I that the Finance Director is hereby authorized to dispose of real property by
sale in fee simple of the chlorinator site (Tax Map Key (3)5-4-003-016) and tank site (Tax
Map Key (3)5-4-002-008) to the Water Board ofthe County of Hawai'i for the sum of ONE
DOLLAR ($1.00) pursuant to Section 2-120, Hawai'i County Code.
BE IT FURTHER RESOLVED that the County Clerk shall transmit a copy of this
resolution to (1) Mayor William Kenoi; (2) Nancy Crawford, Director of Finance; (3) Milton
Pavao, Manager, Department of Water Supply; and (4) Deputy Corporation Counsel Craig
Masuda.
