RESOLUTION NO. 320 00
A RESOLUTION AUTHORIZING THE COUNTY OF HAWAII TO ENTER INTO AN AGREEMENT WITH
THE DEPARTMENT OF DEFENSE, STATE OF HAWAII, FOR THE PURPOSE OF MAINTAINING AND
UPKEEPING VETERANS CEMETERY FACILITIES
WHEREAS, the State of Hawaii, through its Department of Defense, wishes to enter into a Memorandum of
Understanding with the County of Hawaii, whereby the County, through its Department of Parks and Recreation, would
be paid $22,500.00 for the maintenance and upkeep of veterans cemeteries established and located within the County,
during the period July 1, 2000 to June 30, 2001; and
WHEREAS, the State of Hawaii may enter into agreements with the County of Hawaii providing for the
co-sponsorship and joint development and maintenance of programs and projects which have been authorized by the
legislature.
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Mayor
of the County of Hawaii is hereby authorized to sign, the above-referenced agreement with the Department of Defense,
State of Hawaii, for the maintenance and upkeep of veterans cemetery facilities.
BE IT FURTHER RESOLVED that the County Clerk is hereby directed to forward copies of this resolution to
the Department of Defense, Office of the Adjutant General, State of Hawaii, and the Department of Parks and
Recreation, County of Hawaii.

MEMORANDUM OF UNDERSTANDING
TIIIS MEMORANDUM OF UNDERSTANDING made this _ day of ,
200 , by and between the S'fATE OF HAWAII by its DEPARTMENT OF DEFENSE,
hereinafter called the "State" and the COUNTY OF HAWAII, Department of Parks and
Recreation, 25 Aupuni Street, Room 210, Hilo, I lawaii 96720 hereinafter called the "County",
W ITNESSETH
That the County agrees by June 30, 2001, to use the ftmds provided herein by the State, to
pt'ovide, itt accordance with HRS 3G3-5, for the establishtneut of the yeteraus centete~ or
cemeteries located within their respective counties, which includes gradi~~, filling, leveling,
platting paving of roadways and walks, installation of curbs, building offences, planting of
i;rass, trees and shrubs, erection of memorial buildines and monuments, attd building_of other
necessary or convenient structures, and the maintenance and upkeep of such cemetery facilities.
That the County shall provide the above-mentioned service as an independent contractor and
expressly agrees to pay any expense, liabilities or costs incurred in providing said service and
shall indemnify, defend, and hold harmless the State Crom any and all claims and demands
whatsoever of any kind or nature that maybe brought against the State by reason of any matter or
thing arising out of or concerning the service provided by the County.
That for and in consideration of the service rendered by the County, the County will issue an
invoice on a yuarterly basis for the sum of FIVE THOUSAND SIX HUNDRED TWENTY-
FIVE AND 00/100 DOLLARS ($5,625.001, and the State agrees to pay the County the total sum
of"TWENTY-TWO THOUSAND FIVE HUNDRED AND 00/100 DOLLARS ($22,500.001 for
the period July 12000 to Juue 30, 2001 provided from State Funds Account No 621-G-O1-100-
G-7280-V000.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement, effective the day
and year above written.
