Bellman: EPA has received your letter of March 18, 2008 regarding the cesspools at the above referenced properties and TMKs. The EPA's large capacity cesspool ban and closure requirements regulate any cesspool that receives domestic waste (sewage) from commercial properties that have the capacity to serve 20 more persons per day. Based on the information provided, the cesspools at these commercial facilities receive only gray water. Therefore, this facility is not subject to EPA's federal ban on large capacity cesspools. We have updated our records to indicate that this cesspool is not a large capacity cesspool. Thank you for providing this information. If there are any changes to the operations or status of the cesspools at this property, you are required to notify EPA.
