proposed activity is required.

VARIANCE APPLICATION NO. WW 318

Pursuant to H.R.S. Section 342D-7(i), Hawaii Revised Statutes, the State
Department of Health (DOH) seeks written comments from interested persons
regarding the following. Mr. William J. Bellman of P.O. Box 523 Pahoa, Hawaii 96778,
has applied for a variance for the maximum of five (5) years as stated in the variance
application from Hawaii Administrative Rules (HAR) Section 11-62-03, the definition of
an "Individual wastewater system," means a facility which is used and designed to
receive and dispose of no more than one thousand gallons per day of domestic
wastewater. Each individual wastewater system includes all connected plumbing,
treatment (if any), and disposal components that could, if not connected, serve as
separate wastewater system.
Mr. William J. Bellman is the owner and applicant of the Suds N Duds Inc. dba
Suds N Duds Laundromat. The applicant is requesting another five (5) year renewal of
his original variance, Variance No. V210 (and WW 160 Docket No. 04-VWW-12) of the
use of two (2) cesspools serving a 42-washer Laundromat known as the Suds N Duds
Laundromat on 5.48 acres in the Keaau Town Center, 16-586 Old Volcano Road, Suite
101, Keaau, Hawaii 96749 TMK (3) 1-6-143: 034.
The applicant has made the following comments.
1. We are requesting a five (5) year variance renewal. Please refer to
Variance V-210.
2. Conditions are unchanged since Variance V-210 was granted.
3. A five (5) year variance renewal is being requested as no municipal
sewage system is planned for the foreseeable future.
4. A UIC Permit has been obtained (JH-1915).
Additional information (including but not limited to the Safe Drinking Water
Branch's "Information for Variance Evaluation by UIC Program", County of Hawaii Letter
dated August 9, 2004 and USEPA letter dated April 28, 2008 have been attached to
this application for variance but can not be shown here. If you would like to review the
complete application, please call or write to the Wastewater Branch, 919 Ala Moana
Boulevard, Room 309, Honolulu, Hawaii 96814-4920, (808) 586-4294 and/or fax (808)
586-4300 to obtain a facsimile. DOH will consider all written comments received within
thirty days of this notice. If warranted, DOH may hold a public hearing on the variance
application, after receipt of related documents and written comments, if any.

RE: Federal Regulations Regarding Large Capacity Cesspools
Thank you for participating in the public meeting regarding the U.S
Environmental Protection Agency's regulations that require the elimination of large
capacity cesspools by April 5, 2005.
In accordance with the federal regulation's definition of a large capacity cesspool,
discussions with EPA and the State Department of Health officials, and the information
you provided, it appears that you are riot utilizing a large capacity cesspool(s).
Therefore, the subject regulations do not aaggly to you. Please be advised, however, that
the EPA is the final authority on this issue. A copy of this letter is being forwarded to
EPA for any follow up action.

Dear I'vIr. Bellman:
EPA has received your letter of March 18, 2008 regarding the cesspools at the above
referenced properties and TMKs. The EPA's large capacity cesspool ban and closure
requirements regulate any cesspool that receives domestic waste (sewage) from commercial
properties that have the capacity to serve 20 more persons per day. Based on the information
provided, the cesspools at these commercial facilities receive only gray water. Therefore, this
facility is not subject to EPA's federal ban on large capacity cesspools. We have updated our
records to indicate that this cesspool is not a large capacity cesspool. Thank you for providing
this information.
If there are any changes to the operations or status of the cesspools at this property, you
are required to notify EPA. If there are any questions, please feel free to contact me at (415) 972-
