Your Committee on Public Safety and Parks and Recreation, to which was referred Bill 142,
reports as follows:
Bill 142, transmitted via Communication 512, from Councilmember Emily I. Naeole, dated
September 21, 2009, is an ordinance amending Chapter 14, Article 1, Section 14-2.2 and
Section 14-2 of the Hawai'i County Code 1983 (2005 edition, as amended), relating to
consumption of intoxicating liquors at Isaac Kepo'okalani Hale Beach Park, changing the current
provision allowing consumption of alcohol to one requiring a permit.
There were no public testifiers.
Councilmember Naeole related many stories of drunkenness and other poor public behavior at
the park, in addition to insufficient police and security presence to handle the frequent incidents.
Mitch Roth, Hawai'i County Deputy Prosecuting Attorney, spoke on behalf of Prosecuting
Attorney Jay Kimura, and stated that similar issues exist at many beach parks and the Office of
the Prosecuting Attorney would like to recommend it be expanded to include all County Parks.
Your Committee on Public Safety and Parks and Recreation is in accord with the purpose and
intent of Bill 142 and recommends passage at first reading.
