RESOLUTION RELATING TO "IMPROVEMENT DISTRICT NO. 12 - KAUILA STREET SEWERS,"
IN THE DISTRICT OF SOUTH HILO, COUNTY OF HAWAII, CONDITIONALLY ACCEPTING
A BID FOR THE WORK TO BE THEREIN PERFORMED AND DIRECTING THE CHIEF ENGINEER
OF THE DEPARTMENT OF PUBLIC WORKS TO PREPARE A CORRECTED MAP AND PRELIMINARY
ASSESSMENT ROLL.
WHEREAS, due advertisement for bids upon proposal for "Improvement

District No. 12 - Kauila Street Sewers," South Hilo, Hawaii (Job No. S::::1870),
having been had, and the time for receiving tenders therefor having expired
at 2 o'clock p.m., November 22, 1972; and
WHEREAS, competitive bids for the improvements have been received and
were duly opened after the expiration of the call as aforesaid; and
WHEREAS, at the close of bidding as aforesaid, one bid for the improve-
ment was received and opened by the Chief Engineer and submitted to the
County Council by the Chief Engineer of the Department of Public Works, to wit:

Time of Completion: Seventy-five (75) consecutive working days after official
notification from Chief Engineer to proceed with construc-
tion; and
WHEREAS, the lowest bidder for the improvements is Moses Akiona, Ltd.,
which has offered to furnish and pay for all material, including tools,
equipment and labor, necessary to construct and fully complete the entire
improvement in "Improvement Distriet No. 12 - Kauila Street Sewers," South
Hilo, Hawaii, for the total sum of THIRTY-THREE THOUSAND ONE HUNDRED TWENTY-
FOUR AND NO/lOO DOLLARS ($33,124.00); and
WHEREAS, after due consideration by this Council, it is deemed advisable
to accept this tender on the basis of the terms set forth in its approval
for the improvements, as set forth in the form duly advertised and agreed
to by said bidder, and waiving all defects,

NOW, THEREFORE, BE IT RESOLVED BY THE COUNTY COUNCIL in and for the
County of Hawaii:
I
That the proposal for the improvements, as submitted by Moses Akiona,
Ltd., to furnish and pay for all material, including tools, equipment and
labor, necessary to construct and fully to complete the entire improvement
in "Improvement District No. 12 - Kauila Street Sewers," South Hilo, Hawaii
(Job No. S-1870), as set forth in the specifications attached to said
proposal be and the same is hereby accepted by this Council, contingent upon
the further progress of the proceedings relating to said "Improvement District
No. 12 - Kauila Street Sewers," South Hilor, Hawaii, to a final award of the
contract for the work in due course under the provisions of the improvement
'district Ordinance No. 350, and upon the understanding that upon notice of
the final award of this Council, said bidder will execute a contract for the
work and furnish bond as required by law and said specifications; said proposal
for the improvements being for the total sum of THIRTY-THREE THOUSAND ONE
HUNDRED TWENTY-FOUR AND NO/lOO DOLLARS ($33,124.00).

That the Chief Engineer of the Department of Public Works be and he is
hereby directed and requested to prepare a corrected map and preliminary
assessment roll of said "Improvement District No. 12 - Kauila Street Sewers,"
South Hilo, Hawaii, and a list of all known owners, lessees and occupants
of the land situate within said improvement district showing in detail the
proportionate amount proposed to be assessed against sa~d land, all in such
form as may be used as a basis for a public hearing to be had respecting
the proposed assessment according to the provisions of said improvement
district ordinance.

That the County Clerk is hereby authorized and 'directed, to notify said
bidder of the action herein taken and of the conditional acceptance of its
bid on its proposal for the street and water improvement acco~ding to the terms
thereof; and further notify the Chief Engineer of the Department of Public
Works to prepare the data as herein requested and directed.
