County of Hawaii-State of Hawaii Resolution No. 19 RESOLUTION RELATING TO "IMPROVEMENT DISTRICT NO. 12 - KAUILA STREET SEWERS," IN THE DISTRICT OF SOUTH HILO, COUNTY OF llAWAII, APPROVING, RATIFYING, AND ADOPTING THE REPORT OF THE CHIEF ENGINEER OF THE DEPARTMENT OF PUBLIC WORKS ON ASSESSMENTS AGAINST THE PROPERTIES WITHIN SAID IMPROVEMENT DISTRICT AND PROVIDING FOR SUCH BOND ISSUE AS SHALL BE NECESSARY AND AUTHORIZING A PUBLIC HEARING THEREON. J WHEREAS, the Chief Engineer of the Department of Public Works, as directed by the County Council under Resolution No. 13 of 1973, has caused the Assessment Map and Assessment Roll for IMPROVEMENT DISTRICT NO. 12, KAUILA STREET SEWERS, South Hilo, Hawaii, to be prepared, showing in detail the amount per square foot proposed to be assessed against the properties within said Improvement District, and a list of all known owners, lessees, and occupants of the land within said Improvement District No. 12, all of which are incorporated in said Engineer's Report on Assessments dated January 22, 1973, as provided by law; and WHEREAS, said Report and said proposed assessments have been further and fully considered by this Council and a public hearing on the basis thereof is desirable and necessary; NOW, THEREFORE, BE IT RESOLVED by the Council of the County of Hawaii: 1. That the said Report on Assessment of the Chief Engineer of the Department of Public Works dated January 22, 1973, including the Assessment Map and Assessment Roll for IMPROVEMENT DISTRICT NO. 12, KAUILA STREET SEWERS, South Hilo, Hawaii, be and the same is hereby approved, ratified and adopted as and for the Report on Assessments for this Improvement District, subject to such alterations, modifications and amendments as may be here- after adopted according to law and is hereby specifically referred to and incorporated herein. # J '- -..- . .1 2. That all assessments made against the properties within said Improvement District, as set forth in detail in said Engineer's Report, shall b~ payable within thirty (30) days after the date of the last publication of the Assessment Ordinance relating thereto, which shall be hereafter enacted; frovided, that any such assessments may, at the election of the owner of said land assessed, be paid in twenty (20) annual installments of the principal, together with interest on unpaid principal payable annually at the rate of six and one-half per cent (6~%) per annum, the first installment to be due and payable within thirty (30) days after the date of the last publication of the Ordinance aforesaid. PROVIDED, HOWEVER, that the method and rate of payment may be modified according to law after the public hearing, as hereinafter authorized. ~. That the County of Hawaii may issue sufficient improvement bonds to raise such amounts as shall be due in deferred installments, said bonds to be in such form as shall hereafter be adopted and prescribed by this Council according to law; said bonds to be payable as provided by law and to be for a term not greater than the period allowed for installment payment of assessments. PROVIDED, HOWEVER, that the form, terms, interest and payment of said bonds may be modified according to law after the public hearing as here- inafter authorized. 4. That a public hearing before the County Council sitting as a Board of Equalization be had respecting the total amounts of the proposed several assessments to be held before said Council at the County Council Room on Tuesday March 6, , 1973, at the hour of 7:30 o'clock ~.m., or as soon thereafter as those interested may be heard. That the County Clerk shall give notice on behalf of the Council, as required by law, to the owners, lessees and occupants of the land within said Improvement District, as heretofore established, showing the total amount of the cost of the improvement based upon the bid of the lowest responsible reliable bidder and the maximum rate per square foot for said improvements proposed to be charged to all the land within said J Improvement District, and that the Corrected Map, Preliminary Assessment ,~oll and Description of Properties relating to said Improvement District may be seen and examined at the Office of the Chief Engineer of the Department of Public Works during business hours, at any time prior to and during the date fixed for the hearing; and further give notice to the time and place of said public hearing respecting the proposed assess- ment, at which public hearing the Council will sit as a Board of Equaliza- tion to receive complaints or objections respecting the proposed assess- ment, said notice to be published as provided by law.
