HomeMy WebLinkAboutRES 035 Draft 01 1972-1976 0 \J County of Hawaii-State of Hawaii Resolution No: 35 RELATING TO A GRANT OF VARIANCE FROM THE APPLICATION OF SECTION 4A OF ORDINANCE NO. 53 (DRIVEWAY AP:LROACHES), REVISED ORDINANCE OF THE COUNTY OF HAWAII, 1967, FOR PROPERTY.' DESCRIBED AS TMK 2-4-20, PARCEL 35 AT HILO, HAWAII. WHEREAS, Section 4A of Ordinance No. 53 (Driveway Approaches), Revised Ordinance of the County of Hawaii, 1967, prohibits the construc- tion of driveway widths wider- than thirty six feet; and WHEREAS, Section 8 of said ordinance provides that the Board of Supervisors, now County Council, may, by resolution, grant variances from the strict application of the provisions of that ordinance after consultation with the Planning Commission, and under certain conditions, to wit: "A. The exception or variance desired arises from the developer wanting to provide wider ingress and egress driveways for smoother traffic flow within the parking area together with the full utilization of the limited area including landscaping. IIB. That the exception or variance desired is not against the public interest, particularly safety, convenience, and general welfare. MC. That the granting of the permit for the exception or variance will not adversely affect the rights of adjacent property owners or tenants. IND. That the strict application of the terms of this ordinance will work unnecessary hardship and practical difficulty on the property owner or tenant." and WHEREAS ,_the County~Cdunc•'l having consulted with the Planning Director and the Chief Engineer=arid'`liaving found that the above-mentioned conditions have been met; nfow., -there foVaa BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that a variance from the application of Section 4A of Ordinance No. 53 be granted for the proposed driveway to Tax Map Key 2-4-20: Parcel 35, located on Ainaola Drive at the Northeast corner of the intersection of Kupulau Road and Ainaola Drive; and BE IT FURTHER RESOLVED that by this grant of variance it is under- stood that for the purpose of ingress and egress to Paul-Matsumoto residence located at 1142 Ainaola Drive, adjoining the Ainaola Cash and Carry Store, this may be constructed greater than thirty six feet but not more than eighty-five feet; and BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to Mr. Paul Matsumoto, and the Chief Engineer and the Planning Director of the County of Hawaii.
