('~ ..< ~i, ) / ~~~..~ .J C011llty of Hawaii..-State of Hawaii Resolution WHEREAS, the adoption of an Affirmative Action Program for the County of Hawaii is required under applicable Civil Rights legislation and Executive Orders; WHEREAS, the County of Hawaii submitted documents to the Department of Housing and Urban Development by letter of April 25, 1972; and WHEREAS, the draft as submitted by the County of Hawaii has been approved by the Equal Opportunity Division of the Department of Housing and Urban Development as the Affirmative Action Program of the County of Hawaii; now, therefore, BE IT RESOLVED that it is the policy of the County of Hawaii to follow in letter and spirit the provisions of the National civil Rights Act and the President's Executive Order on Civil Rights in the area of contractual, tenant selection, employment practices of the County of Hawaii including promotion, staff training, grievance machinery and overall approaches to personnel matters affecting minorities; BE IT FURTHER RESOLVED that the program:, submitted to the Department of Housing.~and Urban Development is the Affirmative Action Program of the County of Hawaii; and BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to the Department of Housing and Urban Development. " t' '. ~ ~. . o DRAFT - 4/25/72 o COUNTY OF HAHAII STATE OF HAHAII AFFIRMATIVE ACTION PROGRAM In compliance with Presidential Executive Order No. 11246, as amended by Executive Order No. 11376, regarding Equal Opportunity in Employment, the County of Hawaii hereby submits the following Affirmative Action Program as an integral component of its basic policy. I. General Policy Statement It is the policy of the County of Hawaii to provide and promote equal opportunity in County employment for all qualified persons, to prohibit discrimination in employment because of race, creed, color or national origin, through a positive, continuing program in each department and agency. The policy of equal opportunity applies to every aspect of the County's employment policy and practice. II. Equal Employment Opportunity Officer Edward L. Silva, Hawaii County Director of Personnel Services, is designated as the Equal Employment Opportunity Officer for the County of Hawaii. Furthermore, each major department of the County with contract administration responsibilities shall appoint a departmental Equal Employment Opportunity Officer to assist the principal officer in carrying out this program. The Equal Employment Opportunity Officer shall have the res- ponsibility of promoting, coordinating and monitoring the County's Affirmative Action Program for compliance with the provisions as outlined in Title VI of the Civil Rights Act of 1964, Section 808 of , the Civil Rights Act of 1968, and Executive Orders 11063, 11246, 11375, 11376, as they relate to nondiscrimination on the bfisis of race, color, creed or national origin. ). o o .c.' l The duties and responsibilities of the Equal Employment Opportunity Officer are as follows: 1. Review and monitor all contract developments to ensure achievement of equal employment opportunity, open occupancy and public accomo- dation objectives; conduct on-site inspections, at regular intervals, of employment, occupancy and accommodation practices. 2. Assist the County administration and contractors in preparing ~ffective program criteria; chair pre-award and pre-occupancy conferences; compile and disseminate public information for the Mayor and his Department Heads; implement equal employment opportunity policies and open occupancy statements; direct pre- paration of related correspondence including recommendations on equal opportunity practices. 3. Investigate formal complaints of alleged discrimination by parties to agreements and recommend procedures to ensure compliance with all County contract provisions which promote equal opportunity objectives in all County programs and activities. 4. Participate iV programs and conferences regarding fair and equal opportunity practices and assist in servicing Affirmative Action Programs. 5. Consult with and advise the Mayor and Department Heads on matters pertaining to the administration of an equal employment opportunity program for the County staff. 6. Establish and maintain contact as the County's primary working liaison and representative with the community, all public agencies, contracting groups, and labor unions with regard to equal employment ~olicies and opportunities. 7. Work with schools, minority group agencies and organizations to encourage entrance of ITlinorities into employment and training programs, and assist in the development of new training resources. -2- 'J,. o o ,..... III. In-House Program ~he employment, upgrading, demotion, or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or ocher founs of compensation; and selection for training, including apprenticeship; layoff or termination; rates of payor other forms of compensation; and selection for training, including apprenticeship; shall be done in accordance with the rules and regulations of Hawaii County's Department of Personnel Services, and the Hawaii State Civil Service Law as prescribed in Chapter 76 of the Hawaii Revised Statutes. It is. the purpose of the Civil Service Law to establish in the State and each of the counties a system of personnel adminis- tration based on merit principles and scientific methods governing the classification of positions and the employment, conduct, movement, and separation of public officers and employees. It is also the purpose of the Civil Service Law to build a career service in government which will attract, select, and retain the best of our citizens on merit, free from coercive political influences, with incentives in the form of genuine opportunities for promotions in the service, which will eliminate unnecessary and inefficient employees, which will provide technically competent and loyal personnel to render such service according to the dictates of ethics and morality. IV. Specifics Relative to Third-Party Relationships All non-Federal or non-Federally assisted projects - contractors, subcontractors, developers, consultants, appraisers and other technical specialists - will be informed by the County of Hawaii that anyone seeking a contract with the County must undertake a program of equal employment opportunity. Any company or individual discriminating in his employment practices on the basis of race, creed, color, or ' -3- -... l i ~ l """(""'_ ~~ e.~ o o national origin, will not be eligible for contracts with the County. It will .be the responsibility of the County to monitor these procedures and activities for compliance, and to undertake any necessary corrective measures. The actions and guidelines contained in this policy shall be applicable also to all third parties involved in the project. The County's obligation shall be with reference to Title VI of the Civil Rights Act of 1964; Section 808 of the Civil Rights Act of 1968; and Executive Orders 11063, 11246, 11375, 11376 and such other supplements to the basic Civil Rights Act and Housing Acts regarding equal employment opportunity. The County of Hawaii will be responsible for reviewing the adequacy of the Affirmative Action Program submittals, the monitoring for compliance with the provisions in the program, and for undertaking all necessary corrective action. -Lf-
