Resolution No. 73
RELATING TO A GRANT OF VARIANCE FROM THE APPLICATION OF SECTION
4C OF ORDINANCE NO. 53 (DRIVEWAY APPROACHES), FOR PROPERTY DESCRIBED
AS TMK 2-5-04: PARCEL 8, AT HILO, HAWAII.
WHEREAS, Section 4C of Ordinance No. 53 (Driveway Approaches),
prohibits the construction of driveway approaches closer than five
feet from the points of curvature and/or tangency, where 20-foot radius
curves are provided at street intersections; and
WHEREAS, Section 8 of said ordinance provides that the Board
of Supe rvisors, now County Council, may, by reso lution, grant variances
from the strict application of the provisions of that ordinance after
consultation with the Planning Commission, and under certain conditions,
to wit:
IIA. The exception or variance desired arises from the
acquisition of additional road right-of-way for the Wilder Road
Improvement District, which necessitated the removal of existing
structures and relocating driveways.
liB. That the exception or variance desired is not against
the public interest, particularly safety, convenience, and general
welfare.
IIC. That the granting of the permit for the exception or
variance will not adversely affect the rights of adjacent property
owners or tenants.
liD. That the strict application of the terms of this ordi-
nance will work unnecessary hardship and practical difficulty on
the property owner or tenant. II

WHEREAS, the County Council having consulted with the
Planning Director and the Chief Engineer and having found that the
above-mentioned conditions have been met; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that a
variance from the application of Section 4C of Ordinance No. 53, as
amended by Ordinance No. 92, be granted for proposed driveway to
Tax Map Key 2-5-04: Parcel 8; and
BE IT FURTHER RESOLVED that by this grant of variance it is
understood that the porposed driveway may be constructed with one
edge of the driveway abutting the point of curvature and/or tangency
of the 20-foot radius curve with the driveway extending away from
the point of curvature.
BE IT FURTHER RESOLVED that a copy of this Resolution be
transmitted to Mr. Noboru Miyamoto and Gentry Hawaiiana in Hilo,
Hawaii, and the Chief Engineer and the Planning Director of the
County of Hawaii.
