PROVIDING FOR THE ACQUISITION OF RIGHT-OF-MAY FOR
PUBLIC USE, TO-WIT: RIGHTS-OF-WAY AND EASEMENTS
FOR ROAD, DRAINAGE AND WATER PURPOSES IN CONNEC-
TION WITH "IMPROVEI,IENT DISTRICT NO. 15 - WILDER
ROAD IMPROVEMENT," SITUATE AT Y.AUMM1A, COUNTY AND
STATE OF HAWAII, AND DETERMINING AND DECLARING THE
NECESSITY OF THE ACQUISITION THEREOF BY EMINENT
DOMAIN,
BE IT RESOLVED by the Council of the County of Hawaii:
I.
That for public use and purpose, to-wit: Rights-
of-[slay and Easements for road, drainage and water purposes in
connection with "Improvement District No. 15 - Wilder Road
Improvement," situate at Kaumana, County and State of Hawaii,
proceedings in eminent domain as provided by law be instituted
for the acquisition of rights-of-way and easements over, under,
through and across Parcels 1 to 21, inclusive, (including
Parcels 16-A and 16-b), Easements W-1 and W-2, Easements S-1
to S-16, inclusive, (including Easements S-13-A and S-13-B),
Easements S-18 to S-22, inclusive, Easements D to D-5, inclu-
sive, more particularly described in a portion of Exhibit
III-1 attached to the Amendment to Petition filed with the
County Clerk of the County of Hawaii on March 23, 1973, which
portion of said Exhibit III-1 is incorporated herein by refer-
ence as if fully set forth herein, and that the Corporation
Counsel of the County of Hawaii be and he is hereby authorized
and empowered to institute said proceedings.

II.
The foregoing acquisition by emiment domain is
necessary for the aforesaid public use and purpose.
III.
That in the process of said proceedings in eminent
domain, the Corporation Counsel be and he is hereby authorized
and empowered to negotiate terms of settlement, subject to the
approval of this Council and/or of the Court before which such
proceedings are commenced.
